(5) Must not encroach into vehicular circulation areas or be in parking areas. <br />(Per Sec. 3-16.4) <br />(6) Minimum setbacks for any part of the temporary sign structure shall be a <br />minimum of three feet from any right-of-way. (Per Table 3-16.4) <br />(7) No part of any temporary sign shall be placed within the right-of-way or <br />within the visibility triangle or erected in any way which impedes pedestrian <br />and vehicular traffic safety. (Per Table 3-16.4) <br />(8) Temporary signs must be removed and brought inside a building when there <br />are storm warnings so as not to become a hazard during a storm event. <br />B. No provision of this Resolution shall be construed or interpreted as authorizing the <br />installation of an off -premises banner or A -Frame sign. <br />C. The City hereby waives the $4.00 registration fee for all temporary signs enacted <br />under the authority of this Resolution. All temporary signs must still register on a form supplied by <br />the Community Development Department; however, for tracking and safety purposes. <br />C. At such a time as this Resolution is terminated, all banner and A -Frame signs <br />installed pursuant to this Resolution must be removed by the business or property owner within 24 <br />hours of said termination. <br />D. This emergency measure shall have the full force and effect of law. Violations of <br />this emergency measure shall constitute a code violation and be punishable pursuant to Section 1-11 <br />of the City Code. <br />SECTION 3. Termination. This Resolution may be expressly terminated by subsequent <br />order of the City Commission or City Manager, but in any event will automatically terminate June <br />28, 2020, which is within 60 days of the time that the City's Declaration of Emergency is scheduled <br />to terminate (absent extension). Upon termination, the additional banner and A -Frame signs shall <br />again be considered prohibited signs under Article XVI of the City's Unified Land Development <br />Regulations. <br />SECTION 4. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 5. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />SECTION 6. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />Resolution 20-3162 <br />Page 4 <br />
