(1) For any person other than the City or its franchisee to collect or transport solid waste <br />or recyclable materials for hire or remuneration of any kind. <br />(2) For any person other than the City or its franchisee to remove solid waste or <br />recyclable materials from any refuse bin, container, collection location or the curbside. <br />(3) For any person other than the City to place solid waste or recyclable materials out for <br />collection in any location not serviced by the franchisee or the City. <br />(4) For any person other than the City to place or cause to be placed any solid waste upon <br />the property of another. <br />(5) For any person other than the City to offer or authorize solid waste or recyclable <br />materials for collection by any person other than the franchisee or the City. However, <br />voluntary and nonprofit organizations may collect recyclable materials, provided that <br />such materials are not removed from containers after placement for collection by the <br />franchisee or the City. <br />(6) For any person other than the City to do any act prohibited or fail to do any act <br />required by this Article or by regulations adopted pursuant to this Article. <br />(7) For any person other than the City to withhold payment as required by this Article or <br />not conform to the solid waste rate resolution. <br />Secs. 70-31870-50. - Reserved. <br />DIVISION 2. - RATES AND CHARGES <br />acct. i -5r. - Establishment or rates and deposit. <br />The City shall by resolution set residential solid waste collection rates, and may establish <br />security deposits, for all customers served under the terms and conditions of the franchise <br />agreement for collection of solid waste. These rates shall be reviewed periodically and shall be <br />adjusted based on available data such as current cost paid to the contractor for services, <br />administrative cost incurred by the City and any cost associated with compliance with state, <br />county or federal environmental regulations. This resolution will be known as the solid waste <br />rate resolution. <br />Sec. 70-52. - Responsibility for payment of charges. <br />The owner and occupant of each residential collection unit, whether or not it is occupied, <br />shall be responsible for payment of the fees and deposits prescribed in this Article and the solid <br />waste rate resolution. <br />Sec. 70-53. - Billing; delinquency. <br />(a) Billing; due date for payment. Residential S -solid waste and recyclable materials collection <br />bills shall be rendered monthly and shall be included with the water, sewer and utility tax <br />bill, but each charge shall be shown as a separate item on the bill. The charges shall be <br />governed by the same due date and delinquent date and shall be payable within 20 days from <br />the billing date. Any payment not received by the City within 20 calendar days from the <br />billing date shall be delinquent. <br />Ordinance 20-1534 <br />Page 7 of 21 <br />
