Section 2-7.38. — Collection Bins. <br />A. Duties and Responsibilities. <br />1. It is the duty and responsibility of both the record property owner and the <br />collection bin owner to comply with the provisions of this Section co- <br />equally. The record property owner and collection bin owner are <br />individually, jointly, and severally liable for any violation of this Section. <br />2. It is the duty and responsibility of the collection bin owner to request <br />placement of a collection bin on the record property owner's site prior to <br />placement of the collection bin. The collection bin owner must obtain <br />notarized written authorization from the record property owner andrp ovide <br />that written authorization to the City of Casselberry (City) to receive a local <br />business tax receipt, prior to establishment of the collection bin on the <br />property. <br />3. It is the duty and responsibility of the collection bin owner to apply for a <br />local business tax receipt in the collection bin owner's name and to keep <br />that license current. A local business tax receipt is non -transferable between <br />a collection bin owner, a record property owner, and a non-profit charitable <br />entity for a collection bin on a property. The collection bin owner must <br />verify compliance with all requirements of Chapter 496 Florida Statutes <br />and this Code of Ordinances, as amended from time to time prior to <br />obtaining a local business tax receipt. <br />4. It is the duty and responsibility of the collection bin owner to maintain the <br />collection bin through the entirety of collection bin use while on the record <br />property owner's site. City code enforcement staff will notify the record <br />property owner for litter or debris outside of the collection bin and shall <br />enforce the City's Code of Ordinances for collection bin maintenance. <br />B. Each collection bin is subject to obtaining a local business tax under Article II <br />Sections 26-26 through 26-45, as amended from time to time. <br />C. Location and Site Requirements: <br />1. Collection bins are only permitted on developed property located in the <br />City's commercial or industrial zoning districts. <br />2. Collection bins must be located on improved graded level and paved <br />surfaces that constitute part of the collection bin location. <br />3. Collection bins must: <br />a. Not exceed 6.0 -feet in height 5.0 -feet in width and 5.0 -feet in depth; <br />Ordinance 20-1531 <br />Page 3 of 5 <br />
