CASSELBERRY CITY COMMISSION <br />Minutes of October 28, 2019 — Regular Meeting <br />Page 9 of 11 <br />Planning Agency (LPA), voted at its meeting on September 11, 2019 to recommend denial of Ordinance <br />19-1529 to the City Commission. Florida Statutes Chapter 163.045 preempts local governments from <br />requiring a tree removal permit for trees on residential property that pose a danger to persons or property <br />and exempts those properties from mitigation requirements for that tree removal. In response to questions <br />froln the City Commission, Ms. Hanna and Assistant City Attorney Neysa Borkert advised that additional <br />legislation had been passed which would require local governments to pay attorneys' fees for a property <br />owner who challenged regulations which were preempted by the State, and that was also taken into <br />consideration when this ordinance was being developed. They advised that the Planning and Zoning <br />Commission did not have information about the additional legislation when the decision was made to <br />recommend denial. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1529 on first reading. <br />Audience Participation: No one came forward to address Ordinance 19-1529. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 19-1529 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried unanimously by voice vote 5-0. <br />11. PUBLIC HEARINGS <br />No items were presented for consideration on this agenda. <br />12. CITIZENS' COMMENTS <br />Mayor Glancy announced persons that wished to make comment or make inquiry on any matter not on the <br />agenda, may request to be recognized during Citizens' Comments. Mayor Glancy announced the rules of <br />decorum. The following individual came forward: <br />1. Jose Romero, 5048 North Woodcrest Drive, expressed concerns about what he felt was an <br />excessive utility bill at a home he owned which had been vacant for over a year. Mayor Glancy <br />advised him to give his name and account information to Finance Director Carol Conroy who <br />would research the issue and contact him with possible options for resolution. <br />No one else came forward. <br />
