Ordinance 19-1524 — Amending the Official Zoning Designation for Property <br />Located at 245 Lake Ellen Drive (ZB 19-07) <br />The City Cleric read Ordinance 19-1524 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE <br />ZONING CLASSIFICATION FROM R-9 (LOW DENSITY SINGLE-FAMILY) TO CG <br />(COMMERCIAL GENERAL) FOR THE APPROXIMATELY 0.69 ACRE PARCEL LOCATED <br />AT 245 LAKE ELLEN DRIVE, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Development Services Manager Emily Hanna stated that Ordinance 19-1524 amends <br />the Official Zoning designation from R-9 (Low Density Single -Family) to CG (Commercial General) for <br />the approximately 0.69 -acre parcel located at 245 Lake Ellen Drive. Notification was provided to the <br />surrounding property owners within 500 feet on August 22, 2019, and written notice for the Official Zoning <br />Map amendment was posted on the subject property on August 28, 2019. The Planning and Zoning <br />Commission, serving as the City's Local Planning Agency (LPA), voted unanimously at its meeting on <br />September 11, 2019 to recommend approval of the amendment to the City Commission. The request to <br />amend the Official Zoning Map from R-9 (Low Density Single -Family) to CG (Commercial General) for <br />the subject property is: consistent with the City's Comprehensive Plan and the Commercial Future Land <br />Use designation; compatible and consistent with the adjacent land uses and zoning districts; and City water <br />and sanitary sewer services are available to the subject property. However, the impact of the proposed <br />Official Zoning Map amendment on existing sewer capacity cannot be determined until the type of use is <br />established and a flow capacity test is completed. In response to a question from Commissioner Hufford, <br />Ms. Hanna advised that the size of the parcel resulting from the combining of this subject parcel with the <br />adjacent commercial parcel which is commonly owned, would be approximately 1.44 acres. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1524 on first reading. <br />Audience Participation: The following individual came forward to address Ordinance 19-1524: <br />1. Ms. Brenda Monger, 15 Plumosa Avenue, expressed concerns about not having received prior <br />notification of the proposed amendment, and about the impact commercial development in the <br />area would have on the surrounding residential areas, including runoff into the small lake and <br />increased traffic flow. <br />No one else came forward. <br />
