ORDINANCE 19-1513 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM HIGH INTENSITY NON-RESIDENTIAL/ <br />MEDIUM DENSITY RESIDENTIAL TO MAJOR THOROUGHFARE <br />MIXED-USE FOR APPROXIMATELY 0.921 ACRES GENERALLY <br />LOCATED AT THE INTERSECTION OF LIVE OAKS BOULEVARD <br />AND SOUTH U.S. HIGHWAY 17-92, AS DESCRIBED IN SECTION I OF <br />THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") is <br />within the corporate boundaries of the City of Casselberry; and <br />WHEREAS, the applicant is requesting a Future Land Use Map (FLUM) change to the <br />Property to establish a uniform Future Land Use designation of Major Thoroughfare Mixed -Use <br />(MTMU) with the adjacent properties under the same ownership; and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, the Property is less than 10 acres, requiring a small-scale amendment to the <br />Comprehensive Plata; and <br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of <br />small-scale comprehensive plan amendments including amendments to the FLUM; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a public hearing considering amendment of the City of Casselberry Future <br />Land Use Map designation for the Property hereinafter described, has been duly held by the City <br />Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens <br />were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan amendment and determined that the Future Land <br />Use designation of the Property, consisting of approximately 0.921 acres, shall be established as <br />Major Thoroughfare Mixed -Use, as defined in Future Land Use Element Objective FLU 1, as <br />amended and supplemented, of the Comprehensive Plan of the City of Casselberay, Florida; and <br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
