ORDINANCE 19-1513 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE FUTURE LAND USE DESIGNATION FROM HIGH INTENSITY NON-RESIDENTIAL/ MEDIUM DENSITY RESIDENTIAL TO MAJOR THOROUGHFARE MIXED-USE FOR APPROXIMATELY 0.921 ACRES GENERALLY LOCATED AT THE INTERSECTION OF LIVE OAKS BOULEVARD AND SOUTH U.S. HIGHWAY 17-92, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the subject property described in attached "Attachment A" ("Property") is within the corporate boundaries of the City of Casselberry; and WHEREAS, the applicant is requesting a Future Land Use Map (FLUM) change to the Property to establish a uniform Future Land Use designation of Major Thoroughfare Mixed -Use (MTMU) with the adjacent properties under the same ownership; and WHEREAS, to allow for appropriate future development, the Property should be developed consistent with the land uses of neighboring parcels; and WHEREAS, the Property is less than 10 acres, requiring a small-scale amendment to the Comprehensive Plata; and WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of small-scale comprehensive plan amendments including amendments to the FLUM; and WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a public hearing with due public notice to consider this FLUM amendment; and WHEREAS, a public hearing considering amendment of the City of Casselberry Future Land Use Map designation for the Property hereinafter described, has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and WHEREAS, after said public hearing, the City Commission of the City of Casselberry, Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use designation of the Property, consisting of approximately 0.921 acres, shall be established as Major Thoroughfare Mixed -Use, as defined in Future Land Use Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City of Casselberay, Florida; and WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
