Ordinance 19-1512 — Amending the Future Land Use Designation for Properties <br />Located along State Road 436 and Oxford Road (LPA 19-06) (Continued from the <br />May 13, 2019 City Commission Meeting) <br />The City Cleric read Ordinance 19-1512 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE <br />FUTURE LAND USE DESIGNATION FROM MAJOR THOROUGHFARE MIXED-USE TO <br />COMMERCIAL FOR APPROXIMATELY 2.306 ACRES GENERALLY LOCATED ON THE <br />SOUTHEAST CORNER OF STATE ROAD 436 AND OXFORD ROAD, AS DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />Staff Presentation: Planner I Christina Hyson stated that Ordinance 19-1512 amends the Future Land Use <br />Map (FLUM) designation from Major Thoroughfare Mixed -Use (MTMU) to Commercial for <br />approximately 2.306 acres of an approximately 4.48 -acre parent tract generally located on the southeast <br />corner of State Road (SR) 436 and Oxford Road. Written notices of this land use application were posted <br />on the subject property on March 27, 2019. The Planning and Zoning Commission, serving as the Local <br />Planning Agency (LPA), voted unanimously at its April 10, 2019 meeting to recommend denial of the <br />amendment to the City Commission and Ordinance 19-1512 was scheduled for the May 13, 2019 City <br />Commission meeting for first reading. At that meeting first reading of Ordinance 19-1512 was continued <br />to the June 10, 2019 City Commission meeting to allow the City an opportunity to confirm with the <br />applicant a request from RaceTrac on behalf of the applicant to withdraw the application from that agenda. <br />Approval of the request will create a condition in which one parcel will be bisected by two Future Land <br />Use designations that limits the development potential of the southern tract. Additionally, the parcel <br />boundary of the proposed amendment is not consistent with the boundaries of recorded subdivision plats or <br />parcel lots lines, or with the legal description of the parcels. The request to amend the Future Land Use <br />Map (FLUM) designation from Major Thoroughfare Mixed -Use (MTMU) to Commercial for the subject <br />property is not consistent with Policy FLU 1.5, Policy FLU 1.22, Policy FLU 8.2, Objective FLU 12, Policy <br />FLU 12. 1, Policy FLU 13. 1, Policy HC 1.1A and Policy HC 5.1C of the City's Comprehensive Plan, and <br />is not consistent with the City's proposed Oxford Park Overlay District. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended denial of <br />Ordinance 19-1512 on first reading. <br />Audience Participation: No one came forward to address Ordinance 19-1512. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 19-1512 on first <br />reading, as presented. Motion was seconded by Commissioner Hufford. <br />Motion failed unanimously by voice vote 0-4. <br />
