CASSELBERRY CITY COMMISSION <br />Minutes of June 10, 2019 — Regular Meeting <br />Page IS of 17 <br />Audience Participation: The following individuals came forward to address this item: <br />1. Mr. Dave Manor, 664 San Pablo Avenue, spoke in support of the City moving forward with <br />construction of the Sausalito Shores Subdivision wall and imposition of the associated special <br />assessment. <br />2. Mr. Isaac Babcock, 401 San Leandro Drive, also expressed support for the City moving <br />forward with construction of the Sausalito Shores Subdivision wall and imposition of the <br />associated special assessment. <br />3. Mr. James Pooler, 683 Sausalito Boulevard, expressed safety concerns relating to the current <br />Sausalito Shores Subdivision wall and voiced support for the City moving forward with <br />construction of a new wall and imposition of the associated special assessment. <br />4. Ms. Amparo Perez, 243 Tallwood Drive, expressed concerns about whether the City or the <br />Sausalito Shores Homeowners' Association would have liability for the wall once constructed, <br />and whether the homeowners would be responsible for maintenance and repair of the wall. <br />5. Mr. Tim Veigle, 305 San Tomas Drive, spoke in support of the City moving forward with <br />construction of the Sausalito Shores Subdivision wall and imposition of the associated special <br />assessment. <br />MOTION: Commissioner Busch moved to approve the City moving forward to pursue <br />construction of the Sausalito Shores Subdivision wall along Red Bug Lake <br />Road, including the associated construction loan and special assessment, as <br />presented. Motion was seconded by Commissioner Hufford. <br />Discussion: A brief discussion ensued during which Mr. Newlon and Dr. Brock clarified that: the City <br />would recover its costs for construction through the special assessment; once completed, the wall would <br />belong to the Sausalito Shores Homeowners' Association which would be responsible for its maintenance; <br />any failure to maintain the wall could be addressed through code enforcement action which would be <br />addressed to the Homeowners' Association, if existing, or to the individual property owners if it was not; <br />and that the current Homeowners' Association is incorporated and a legal and viable entity which owns <br />property, but which does not have the ability to impose assessments on its residents. Several of the <br />Commissioners expressed appreciation to the Sausalito residents for caring about their community and <br />working with staff to reach this point, and for their willingness to accept the special assessment as the <br />method for reimbursement to the City of the construction costs. They also felt that the improvements to <br />the wall would not result in a major impact to the residents' property taxes but would increase property <br />values in the community and surrounding areas. <br />Motion carried unanimously by voice vote 4-0. <br />13. CITIZENS' COMMENTS <br />Mayor Glancy announced persons that wished to make comment or make inquiry on any matter not on the <br />agenda, may request to be recognized during Citizens' Comments. Mayor Glancy announced the rules of <br />decorum. The following individual came forward: <br />1. Ms. Colleen Hufford, 527 Queens Mirror Circle, expressed appreciation to the City <br />Commission, City Attorney and City staff for working towards getting the restricted hunting <br />
