WHEREAS, vacation of the Plat is proper and conforms to the requirements of <br />Section 177.101, Florida Statutes; and <br />WHEREAS, the vacation of the Plat is not inconsistent with the Comprehensive <br />Plan of the City of Casselberry; and <br />WHEREAS, the petition to vacate the entire Plat was duly presented to the City <br />Commission at its regular meeting; and <br />WHEREAS, the City of Casselberry is vested with home rule authority pursuant <br />to Article VII, Section 2 of the Constitution of the State of Florida and Chapter 166, <br />Florida Statutes, as well as the provisions of the City Charter and Chapter 177 Florida <br />Statues, and has the authority to vacate plats. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />Section 1. Recitals. The above recitals are true and accurate and incorporated <br />herein. <br />Section 2. Plat Vacation. The entire Seminola at Karina Plat, recorded in OR <br />Book 83, Page 100, as legally described in Attachment "A", Exhibit "A" attached <br />hereto, is hereby vacated and annulled and the same is hereby returned to non -platted <br />acreage; provided, however, that this action shall not affect any easement or other <br />property rights that may exist. <br />Section 3. Effective Date. This Resolution shall take effect immediately. <br />Section 4. Recording.
