Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 13, 2019 <br />Page 8 <br />Ms. Hanna noted for the record that the site they are discussing is located at the corner of Oxford Road and <br />State Road 436 and it is within the Community Redevelopment Agency (CRA). She said the CRA prohibits service <br />stations. She said if the Planning and Zoning Commission changes this use from a prohibited use to a conditional <br />use in the OPOD, it is still prohibited in the CRA. <br />Ms. Hanna stated that the service station located at Oxford Road and State Road 436 is not within the CRA; <br />however, the SunTrust property is located in the CRA. <br />A general discussion ensued regarding RaceTrac developing on the Sam's Club site or another site in <br />Casselberry, the number of existing service stations located on State Road 436 and the prohibition of a service <br />station in the CRA. In response to the Commission's concern, Mr. Baird explained that RaceTrac does have a policy <br />against loitering on the property. <br />Ms. Hanna stated that Mr. Fathelbab brought to her attention that the OPOD Standards as they are currently <br />written would prevail if there were a discrepancy between the CRA prohibited uses. She explained if service stations <br />were allowed with a conditional use in the OPOD it would override the CRA's prohibiting them. Ms. Hanna reminded <br />the Commission of the Guiding Principles of which the OPOD were written and the fact that the City is trying to have <br />a synergistic mixed -used development with Seminole County. <br />After a general discussion regarding the prohibited and conditional use of a service station in the OPOD, Mr. <br />Henson asked for a motion to address LPA 19-05. Mr. Hale made a motion that the Planning and Zoning <br />Commission provide a favorable recommendation to the City Commission for LPA 19-05, Oxford Park Overlay <br />District Standards, creating Section 2-7.34, Oxford Park Overlay District Standards, amending Section 2-4.3, the <br />Official Zoning Map and amending Section 5-21.2, Definition of Terms including the five attachments. Mr. Bakalla <br />seconded the motion. The motion passed unanimously by voice vote. <br />Ninth Item of Business: Public Comments. <br />There were no public comments. <br />Tenth Item of Business: Other Business. <br />Ms. Hanna reminded the Commission of their joint workshop with the City Commission on March 27, 2019 <br />at 6:00 p.m. in the Police Department Multipurpose room with speaker Mark Fenton. <br />
