CASSELBERRY CITY COMMISSION <br />Minutes of April 8, 2019 — Regular Meeting <br />Page 9 of 13 <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 19-1511 on first reading. <br />Public Hearing: Mayor Glancy stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 19-1511. Mayor Glancy opened the floor for public participation. The <br />following individuals came forward: <br />1. Mr. Tom Sullivan with the Gray Robinson Law Firm, 301 East Pine Street, Orlando, provided <br />a concept plan, two example photos and a proposed red -line copy of Ordinance 19-1511 to <br />the City Clerk for the record and distribution to the City Commission. He then explained <br />that he was present on behalf of RaceTrac Petroleum which currently had a project in the <br />comprehensive planning and rezoning stages of development with the City for parcels located <br />at State Road 436 and Oxford Road, and requested that the City Commission consider <br />amending the ordinance to allow Service Stations/Fuel Dispensing/Gas Stations as a <br />conditional use in the Oxford Park Overlay District. <br />2. Mr. Brian Terry, Land planner and Landscape Architect with Insite Studio, the planning firm <br />for the proposed RaceTrac project at Oxford Road and State Road 436, gave an overview of <br />the conceptual plan which had been provided by Mr. Sullivan, explaining that the plan <br />identified how the RaceTrac gas station could fit into the vision for and within the confines <br />of the Oxford Park Overlay District. He also requested that the City consider allowing the <br />gas station as a conditional use within the Overlay District. <br />3. Ms. Samantha Moore, Project Manager with RaceTrac Petroleum, emphasized the <br />differences between a new RaceTrac and what is traditionally thought of as a gas station and <br />convenience store. She gave an overview of the amenities which would be part of the internal <br />uses, and advised that ongoing maintenance of the site would not be an issue, as corporate <br />landscape agreements were uniform across all RaceTrac sites. She also agreed that the <br />project would blend well with the pedestrian friendly desired use of the Overlay District and <br />requested that the City consider allowing gas stations as a conditional use in the Overlay <br />District. <br />4. Mr. Ken Wright, Attorney with the Shutts and Bowen Law Firm, 300 South Orange Avenue, <br />Orlando, stated he was present on behalf of SunTrust, the owner of the parcel under contract <br />for sale to RaceTrac Petroleum, and also spoke in favor of allowing Service Stations/Fuel <br />Dispensing/Gas Stations as a conditional use within the Oxford Park Overlay District, adding <br />that it would be directly compatible with Seminole County's provisions. <br />No one else came forward to address Ordinance 19-1511. Mayor Glancy closed the public hearing relative <br />to Ordinance 19-1911. <br />MOTION: Commissioner Hufford moved to approve Ordinance 19-1511 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 5-0. <br />
