RESOLUTION 18-3068 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, RECOGNIZING AND CONFIRMING <br />LEGISLATION IN PROGRESS REGARDING AMENDMENTS TO SIZE <br />AND DIMENSION REGULATIONS TO DECREASE THE MINIMUM <br />LIVING AREA; AMENDMENTS TO PARKING SPACES REQUIRED PER <br />LAND USE; AMENDMENTS TO DESIGN CRITERIA FOR BUILDINGS <br />IN EXCESS OF 35 FEET IN HEIGHT; TO AMEND MEDIUM DENSITY <br />RESIDENTIAL USES THAT CAN APPLY FOR A CONDITIONAL USE; <br />PROVIDING FOR LEGISLATIVE FINDINGS; RECOGNIZING <br />LEGISLATION IN PROGRESS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry continuously monitors and reviews the Code of <br />Ordinances and the Unified Land Development Regulations (ULDR) to ensure appropriate <br />regulations for development and zoning within the City, and from time to time recognizes the need <br />to study and amend aspects of same; and <br />WHEREAS, the City of Casselberry adopted Ordinance 16-1446 on July 11, 2016 to <br />decrease the minimum living area and decrease the parking spaces required by use, to align with <br />the reduced minimum living areas specifically within the Major Thoroughfare Mixed Use <br />(MTMU) Future Land Use designation, in light real estate market changes; and <br />WHEREAS, a jurisdictional analysis of the surrounding municipalities shows provisions <br />for smaller living units, smaller parking ratios and taller buildings for multi -family housing <br />specifically in more urban settings, but the City's Unified Land Development Regulations are not <br />consistent throughout the zoning districts for properties zoned for multi -family; and <br />WHEREAS, the City desires to provide consistent design criteria within the multi -family <br />residential development districts within the City and continues to promote and incorporate <br />regulations through legislation in progress to adopt regulations for the purpose and intent of <br />creating a current and consistent Comprehensive Plan and Unified Land Development <br />Regulations; and <br />WHEREAS, the purpose of Resolution 18-3068 is to provide notice that the City is <br />developing an ordinance to amend ULDR Table 2-5.4 to reduce the minimum living area for all <br />multi -family development, to be consist with the minimum living areas for properties within <br />MTMU; amending ULDR Section 3-15.2 to reduce the parking spaces required in all multi -family <br />development to align with the MTMU district requirements; and to add Medium Density <br />Residential Future Land Use designation and the consistent zoning to the list of land uses that can <br />qualify for building heights greater than 35 ft. with Conditional Use approval in ULDR Section 3- <br />10.12. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
