Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 9, 2019 <br />Page 2 <br />and Zoning Commission approve CU 19-02 to allow a 1,200 square foot accessory structure at 1406 Lake Shore <br />Drive. She said staffs recommendation is based on the findings of fact and conclusions of the staff report dated <br />January 9, 2019, and nine (9) conditions of approval outlined in the staff report. The conditions of approval are: <br />1. The conditional use shall be limited to the location of 1406 Lake Shore Drive. <br />2. The accessory structure shall not be utilized for any commercial activity or home occupation. <br />3. The accessory structure shall be utilized solely for storage and shall not be converted to a habitable <br />structure. <br />4. No fill should be brought into the floodplain without compensating storage. If fill is brought to the <br />floodplain, an equal or greater amount of cut needs to be created adjacent to the floodplain area. <br />5. The proposed storage structure will need to be anchored/secured to prevent flotation, collapse, or <br />lateral movement. <br />6. Any additions that increase the height or square footage of the accessory structure will require <br />conditional use approval. <br />7. A building permit must be issued within 120 days of approval. All inspections must be approved by the <br />expiration date of the building permit. <br />8. The use shall remain in complete compliance with all City, County, and State requirements. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Ms. Hyson explained that the proposed structure would meet the <br />required setbacks. She said that the applicant's father built a similar structure and she requested the applicant <br />provide a photo to give a visual representation of the proposed structure. In response to the Commission's question, <br />Ms. Hyson said that the structure would be used for storage of his vehicles and lawn equipment. <br />In response to the Commission's question regarding requiring homes that do not currently have a garage or <br />carport come into compliance when applying for other building permits, Ms. Hyson explained that would be <br />determined based on the type of building permit. <br />In response to the Commission's question, Ms. Hyson explained if a Code Compliance Officer observes <br />work being done on a property, they would check to see if building permits have been obtained. She said if no <br />building permits have been obtained, the Code Officer would speak to the property owner regarding any necessary <br />permits that may be needed for the work they are performing on the site. <br />Mr. Henson asked the applicant to come forward. Mr. David Muniz, 1406 Lake Shore Drive, Casselberry, <br />Florida came forward. There were no questions for the applicant. <br />
