Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />November 14, 2018 <br />Page 2 <br />Fifth Item of Business: BA 18.06: 360 Jasmine Road. A variance request of Article VII, Section 2.7.10(C)(1), of the <br />ULDR to allow a fence within the front yard to exceed the maximum height of three (3) feet for the property located at <br />360 Jasmine Road. Parcel ID: 16-21-30-5BS-0000.2110. <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated November 14, 2018 to <br />the City of Casselberry Planning and Zoning Commission. Ms. Hyson reviewed the criteria required to grant a variance. Ms. <br />Hyson said the variance application meets all six (6) of the criteria for granting the variance; therefore, staff supports the <br />variance request. She said if the Planning and Zoning Commission chooses to grant the front yard fence height and design <br />variance, BA 18-06, for the property located at 360 Jasmine Road, the motion should be based upon the Planning and Zoning <br />Commission's findings of fact and conclusions, the staff report dated November 14, 2018, and the conditions outlined in the <br />staff report. The conditions of approval are: <br />The front yard encroachment is exclusive to the proposed privacy fence that extends ±26 feet into the front yard <br />along Palm Drive and is cumulatively ±79 linear feet in length. <br />A building permit shall be obtained prior to construction of the fence. <br />The fence shall be erected with the finished side facing out. <br />The existing chain link fence must be removed prior to construction of the proposed fence. <br />The fence must present a uniform appearance along each contiguous side. <br />Fence shall run parallel or perpendicular to property lines to ensure a rectangular -like and orderly screen that <br />meets the requirements of ULDR Section 3-10.9(D)(2). <br />All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />In response to the Commission's question regarding the use of landscaping in lieu of the fence, Ms. Hyson said that <br />the applicant needed to access the area and maintaining an 8 foot height adds additional challenges. <br />Mr. Bakalla asked the applicant to come forward. Ms. Erika Galeano, 360 Jasmine Road, Casselberry, Florida came <br />forward. A brief discussion ensued regarding the fence requiring a variance due to the home being located on a corner lot. <br />Mr. Bakalla asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Ms. Courtney Icenhower, 361 Iris Road, Casselberry, Florida came forward to speak in favor of the request. Ms. <br />Icenhower said she is their backyard neighbor. She said the fence would beautify the neighborhood and it would back up to <br />herfence. <br />A brief discussion ensued regarding fencing for corner lots and the maximum height allowed for trailers parked in a <br />residential zoning. <br />Mr. Bakalla asked for a motion to address BA 18-06. Mr. Phillips made a motion that the Planning and Zoning <br />Commission approve the variance application as it meets all six (6) of the criteria for granting such a variance along with the <br />
