Mr. Phillips made a motion that the Planning and <br />Zoning Commission approve CU 18-15 to allow a place of worship and day care facility at 350 Anchor Road, Suite <br />1050 based on staffs recommendations, the findings of fact in the staff report dated September 12, 2018, and the <br />nine conditions outlined in the staff report including Attachments A — D. Ms. Campbell seconded the motion. The <br />motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 18-16: 231 Lake Ellen Drive. A conditional use request to allow a boat dock <br />located at 231 Lake Ellen Drive. <br />Mr. Jonathan Tardif, Planning Technician, reviewed the information provided in his memorandum dated <br />September 12, 2018. Mr. Tardif said staff recommends the Planning and Zoning Commission approve CU 18-16 to <br />allow a residential boat dock at 231 Lake Ellen Drive. He said staffs recommendation is based on the findings of fact <br />and conclusions of the staff report dated September 12, 2018 and the six conditions of approval outlined in the staff <br />report. The conditions of approval are: <br />1. All Public Works conditions must be met. These conditions include the following: <br />a. A building permit will be required for the proposed dock. The following are <br />conditions and/or items that will apply to said permit. This list is not necessarily <br />exhaustive: <br />i. The structure may require a permit through Florida Department of Environmental <br />Protection (FDEP). Evidence of an FDEP permit or exemption/self-certification must be <br />provided with a building permit submittal. More information can be found at <br />http://www.dep.state.fl.us/water/wetiands/. <br />ii. As this structure exceeds four feet in width, the City's Unified Land Development <br />Regulations (ULDR) with regard to Environmental Protection apply to this structure. In <br />particular, Section 3-11.5 Lakeshore Protection will apply. The submittal should include a <br />plan for permanent native re -vegetation of the shoreline to bring it into compliance with <br />City Code and State Law. City staff can assist by suggesting plant species if needed. <br />More information can be found at http://www.casselberry.org/lakes. <br />iii. NO FILL may be imported without compensating storage as part of the dock's <br />construction for the portion that lies within the Special Flood Hazard Area (SFHA), also <br />known as the 100 year floodplain. <br />2. The conditional use shall commence within 120 days of the approval. <br />3. The dock must be kept in good condition. The conditional use shall become null and void if the <br />dock sustains damage or falls into disrepair and is not repaired or replaced within six months and is <br />taken before the Special Magistrate for the Code violation. <br />4. A new conditional use will be required if the size or dimensions of the dock is increased. <br />5. The site's numerical address must be clearly posted on the dock in an area that is visible from the <br />waterbody. <br />6. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />
