Planning & Zoning Commission/ Local Planning Agency Minutes August 8, 2018 Page 2 Fifth Item of Business: CU 18-14: 2COP at 505 State Road 436. A conditional use request to allow the sale of beer and wine for on-site consumption at the Four Guys Pho Restaurant located at 505 State Road 436. Ms. Emily Hanna, Development Service Manager, reviewed the information provided in staffs memorandum dated August 8, 2018 to the City of Casselberry Planning and Zoning Commission. Ms. Hanna stated that the applicant had previously received conditional use approval to sell beer and wine but that conditional use has since expired. Ms. Hanna said staff recommends the Planning and Zoning Commission approve CU 18-14 to allow the sale of beer and wine (2COP) for on-site consumption at 505 State Road 436. She said staffs recommendation is based on the findings of fact and conclusions of the staff report dated August 8, 2018, and the following conditions: 1. The conditional use shall be limited to the location of 505 State Road 436. 2. All sales and consumption of alcoholic beverages shall be on-site and indoors. 3. Package sales of alcoholic beverages for off-site consumption shall be prohibited. 4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. 5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Sec. 10-2 of the City of Casselberry's Code of Ordinances and shall only be during times when the primary use (the restaurant) is serving food. 6. There shall be no outside display or storage of goods, materials, services, or vehicles. 7. The conditional use shall commence within 120 days of approval. 8. All applicable licenses and permits shall be obtained prior to commencing the sale of beer and wine at the site. 9. The use shall remain in complete compliance with all City, County, and State requirements. 10. A new conditional use application shall be required if the use should cease for more than 90 days. 11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. Mr. Henson asked the applicant to come forward. Mr. Chau Minh Phan, 505 State Road 436, Casselberry, Florida came forward. In response to the Commission's question regarding overflow parking on the adjacent parcel, Mr. Phan said the landlord for that property has given his permission to use that property for additional parking. Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Henson asked for a motion to address CU 18 -04. Mr. Hale made a motion that the Planning and Zoning Commission approve CU 18-14 to allow the sale of beer and wine (2COP) for on-site consumption at 505 State Road 436 based on the findings of fact and conclusions of the staff report dated August 8, 2018, and the
