Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />August 8, 2018 <br />Page 2 <br />Fifth Item of Business: CU 18-14: 2COP at 505 State Road 436. A conditional use request to allow the sale of <br />beer and wine for on-site consumption at the Four Guys Pho Restaurant located at 505 State Road 436. <br />Ms. Emily Hanna, Development Service Manager, reviewed the information provided in staffs memorandum <br />dated August 8, 2018 to the City of Casselberry Planning and Zoning Commission. Ms. Hanna stated that the <br />applicant had previously received conditional use approval to sell beer and wine but that conditional use has since <br />expired. <br />Ms. Hanna said staff recommends the Planning and Zoning Commission approve CU 18-14 to allow the <br />sale of beer and wine (2COP) for on-site consumption at 505 State Road 436. She said staffs recommendation is <br />based on the findings of fact and conclusions of the staff report dated August 8, 2018, and the following conditions: <br />1. The conditional use shall be limited to the location of 505 State Road 436. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption shall be prohibited. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Sec. 10-2 of <br />the City of Casselberry's Code of Ordinances and shall only be during times when the primary use (the <br />restaurant) is serving food. <br />6. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />7. The conditional use shall commence within 120 days of approval. <br />8. All applicable licenses and permits shall be obtained prior to commencing the sale of beer and wine at <br />the site. <br />9. The use shall remain in complete compliance with all City, County, and State requirements. <br />10. A new conditional use application shall be required if the use should cease for more than 90 days. <br />11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Henson asked the applicant to come forward. Mr. Chau Minh Phan, 505 State Road 436, Casselberry, <br />Florida came forward. In response to the Commission's question regarding overflow parking on the adjacent parcel, <br />Mr. Phan said the landlord for that property has given his permission to use that property for additional parking. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 18 -04. Mr. Hale made a motion that the Planning and <br />Zoning Commission approve CU 18-14 to allow the sale of beer and wine (2COP) for on-site consumption at 505 <br />State Road 436 based on the findings of fact and conclusions of the staff report dated August 8, 2018, and the <br />
