RESOLUTION 18-3062 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT #3 TO THE BROWNFIELD CLEANUP PROJECT AGREEMENT WITH CARDNO, INC. TO CONDUCT SYSTEM OPERATIONS AND MAINTENANCE, QUARTERLY GROUNDWATER SAMPLING EVENTS, QUARTERLY MONITORING REPORTS, AND WELL INSTALLATION, TOWARDS SITE CLOSURE ACTIVITIES RELATED TO THE POLICE STATION PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry entered into a Brownfields Site Rehabilitation Agreement (BSRA) on June 4, 2013 with the Florida Department of Environmental Protection (FDEP). The City prepared a Brownfields Remedial Action Plan for the subject site located at the City of Casselberry Police Station Brownfield with the address of 4195 South U.S. Highway 17-92 that is also within the City of Casselberry Community Redevelopment Area; and WHEREAS, the City of Casselberry was awarded a grant through the U.S. Environmental Protection Agency (EPA) Cooperative Agreement dated September 21, 2012 for $200,000.00 towards Brownfields remediation of the Police Station Brownfield; and WHEREAS, the City of Casselberry has performed all required actions to date for Brownfield remediation in accordance with the Brownfields Remedial Action Plan through the use of a geotechnical consultant, Cardno, Inc., for a Brownfield Cleanup Project Agreement (Agreement) on October 8, 2012 with Request for Proposal No. RFP2012004CI; and WHEREAS, Cardno, Inc. seeks to comply with additional FDEP recommendations through Amendment #3 to the Agreement to conduct system operations and maintenance, quarterly groundwater sampling events, quarterly monitoring reports, and well installation, towards site closure activities related to the Police Station Brownfield project; and WHEREAS, Amendment #3 to the Agreement results in a cost proposal and scope of services from Cardno, Inc. dated September 14, 2018 for $66,000.00 for Brownfield remediation of the Police Station Brownfield project; and WHEREAS, the City of Casselberry approved in the Fiscal Year (FY) 19 Budget $62,550.00 for Brownfield cleanup activities and approved Resolution 18-3052 for $10,175.00 for Brownfield cleanup of the nearby Lake Concord Park Brownfield project that results in a remainder within FY 19 of $52,375.00 for the Police Station Brownfield project; and WHEREAS, Amendment #3 is requested to also extend the Agreement to use Cardno, Inc. for the Police Station Brownfield remediation project through the end of FY 20 and affirms
