Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />July 11, 2018 <br />Page 8 <br />Twelfth Item of Business: LPA 18-10: Industrial Buffer. Amending Section 2-5.3, Table 2-5.3 and Section 2- <br />7.28, to add additional uses within the Industrial zoning district and provide distance separation <br />requirements for specific uses within the Industrial or Industrial -Medium zoning district. <br />Ms. Emily Hanna, Development Services Manager, reviewed the information provided in her memorandum <br />dated July 11, 2018, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a <br />copy of the PowerPoint presentation is attached and made a part of the minutes). <br />In response to the Commission's question, Ms. Hanna stated that the City is required to have a minimum of <br />four (4) sites available for adult entertainment establishments and sexually oriented businesses. She said the City <br />has a total of five (5) sites. Ms. Hanna said one of the sites is the existing Rachel's site, which is an existing non- <br />conforming use. She explained that the City was sued in 1999 and the Circuit Court rendered a verdict that stated <br />that the City must have a certain number of sites that could house adult entertainment/sexually oriented businesses. <br />She said based on the calculation the City was required to have four (4) sites. <br />In response to the Commission's question, Ms. Hanna stated that the City Code provides definitions for <br />adult entertainment and sexually oriented businesses. A brief discussion ensued regarding the 250 -foot distance <br />separation from any place of worship, park or area zoned for residential uses. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address LPA 18-10. Mr. Lutz made a motion that the Planning and <br />Zoning Commission recommend approval of LPA 18-10 and hereby amend the Unified Land Development <br />Regulations to include distance separation requirements for certain uses within the Industrial and Industrial -Medium <br />zoning district including Attachment A. Ms. Campbell seconded the motion. The motion passed unanimously by <br />voice vote. <br />Thirteenth Item of Business: Public Comments. <br />There was no public comments. <br />Fourteenth Item of Business: Other Business. <br />
