Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />July 11, 2018 <br />Page 2 <br />Fifth Item of Business: CU 18.13: 4COP/SFS at 1410 SR 436. A conditional use request to allow the sale of <br />beer, wine, and liquor (4COP/SFS) for on-site consumption at the Hacienda Vieja Mexican Restaurant located <br />at 1410 State Road 436. <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated July 11, 2018, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hyson said staff recommends the <br />Planning and Zoning Commission approve CU 18-13 to allow the sale of beer, wine, and liquor (4COP/SFS) for on- <br />site consumption at 1410 State Road 436 based on the findings of fact and conclusions of the staff report dated July <br />11, 2018, and the 12 conditions of approval outlined in the staff report. <br />Mr. Henson asked the applicant to come forward. Mr. Jose Uribe, 1410 State Road 436, Casselberry, <br />Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 18-13. Mr. Phillips made a motion that the Planning and <br />Zoning Commission approve CU 18-13 to allow the sale of beer, wine, and liquor (4COP/SFS) for on-site <br />consumption at 1410 State Road 436 based on the findings of fact and conclusions of the staff report dated July 11, <br />2018, and the twelve conditions of approval outlined in the staff report including Attachments A -D. Mr. Bakalla <br />seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: BA 18-03: Variance Request at 300 Kentia Road. A variance request of Article VII, <br />Section 2-7.10(C)(1), to allow a fence within the front yard to exceed the maximum height of 3 feet for the <br />property at 300 Kentia Road. <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated July 11, 2018, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hyson said the variance application <br />meets all six (6) of the criteria for granting the variance; therefore, staff supports the variance request as presented. <br />She said if the Planning and Zoning Commission chooses to grant the front yard fence height and design variance, <br />BA 18-03, for the property located at 300 Kentia Road, the motion should be based upon the Planning and Zoning <br />
