RESOLUTION 18-3052 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF CHANGE ORDER #6 TO THE STANDARD AGREEMENT FOR BROWNFIELD CONTAMINATION MITIGATION WITH APPLIED HYDROGEOLOGIC SOLUTIONS, LLC, TO CONDUCT ONE QUARTERLY GROUNDWATER SAMPLING EVENT, ONE SEMI-ANNUAL MONITORING REPORT, AND SITE CLOSURE ACTIVITIES RELATED TO THE LAKE CONCORD PARK PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry entered into a Brownfield Site Rehabilitation Agreement in 2014 with the Florida Department of Environmental Protection (FDEP) and prepared a Brownfield Remedial Action Plan for the site located within Lake Concord Park at 4355 U.S. Highway 17-92 that is also within the City of Casselberry Community Redevelopment District; and WHEREAS, the City of Casselberry has performed all required actions for Brownfield remediation in accordance with the Brownfield Remedial Action Plan through the use of a geotechnical consultant, Applied Hydrogeologic Solutions, LLC, (AHS) through a Standard Agreement for Brownfield Contamination Mitigation (Agreement) on September 22, 2014, through Bid No. Y14-0006; and WHEREAS, AHS has performed work per the Agreement and five change orders to comply with the FDEP recommendations, with Change Order 45, being approved through Resolution 16-2849 by the City Commission of the City of Casselberry on April 25, 2016, for $11,900.00; and WHEREAS, the City of Casselberry is pursuing site closure activities with AHS and FDEP through a Low -Score Site Initiative No Further Action Order and, based on correspondence from FDEP on July 6, 2018, is requesting Change Order #6 for $10,175.00 to achieve site closure activities; and WHEREAS, Change Order 46 includes action from AHS to perform one (1) quarterly groundwater sampling event, one (1) semi-annual monitoring report by February 4, 2019, per FDEP, for closure activity, and to extend the AHS Agreement through the end of Fiscal Year 2019; and WHEREAS, AHS provided a proposal to the City of Casselberry dated August 8, 2018, as Exhibit A of Resolution 18-3052, in the amount of $10,175.00 to conduct one (1) quarterly groundwater sampling event and one (1) semi-annual monitoring report for closure activity, as Change Order #6 to the Agreement; and
