CASSELBERRY CITY COMMISSION <br />Minutes of July 23, 2018 — Regular Meeting <br />Page 8 of 19 <br />ZONING CLASSIFICATION FROM CITY OF CASSELBERRY PMX-H (PLANNED MIXED- <br />USE: HIGH INTENSITY) TO CITY OF CASSLEBERRY PMX-HIGH (PLANNED MIXED-USE: <br />HIGH RISE) FOR PARCELS GENERALLY LOCATED AT 1241, 1259 AND 1261 STATE ROAD <br />436, CASSELBERRY, FLORIDA AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE." <br />Staff Presentation: Planner Christina Hyson gave an overview of Ordinance 18-1491 which amends the <br />Official Zoning Map from PMX-H (Planned Mixed -Use: High Intensity) to PMX-HIGH (Planned Mixed - <br />Use: High Rise) for four (4) properties generally located at 1241, 1259 and 1265 State Road 436. <br />Notification of the proposed zoning amendment was provided to the surrounding property owners within <br />500 feet and the Planning and Zoning Commission, serving as the Local Planning Agency (LPA), voted <br />unanimously at its meeting on June 13, 2018 to recommend approval of this amendment to the City <br />Commission. The request to amend the Official Zoning Map from PMX-H (Planned Mixed -Use: High <br />Intensity) to PMX-HIGH (Planned Mixed -Use: High Rise) for the subject properties is consistent with the <br />City of Casselberry Comprehensive Plan and the existing Major Thoroughfare Mixed-use (MTMU) Future <br />Land Use designation, compatible with the surrounding mix of land uses and zoning districts, and City <br />services are available at the subject properties and will not be negatively impacted. <br />In response to questions from Commissioner Hufford, Ms. Hyson confirmed that under the original zoning <br />classification residential was an allowed use; however, it was not consistent with the future land use <br />designation to allow future development of the site. She also explained that to allow any changes to increase <br />square footage or add buildings to the site the zoning needed to be changed to be compatible with the future <br />land use. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 18-1491 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1491. <br />MOTION: Commissioner Solomon moved to approve Ordinance 18-1491 on first <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />B. Ordinance 18-1492 — Amending Sections 3.04 and 4.04 of Ordinance No. 09-1301, <br />Master Capital Project and Service Assessment Ordinance <br />The City Clerk read Ordinance 18-1492 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTIONS 3.04 <br />AND 4.04 OF ORDINANCE NO. 09-1301, MASTER CAPITAL PROJECT AND SERVICE <br />ASSESSMENT ORDINANCE, FOR CONSISTENCY WITH SECTION 197.3632(6), FLORIDA <br />STATUTES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE." <br />
