CASSGLBGRRY CITY COMMISSION <br />Minutes of June 11, 2018 — Regular Meeting <br />Page 16 of 22 <br />Discussion: Brief discussion ensued regarding various aspects of the proposed ordinance, including details <br />of the Adopt -A -Tree Application, suggestions for additional clarification as to available sizes and types, <br />and the need to provide instructions for care and maintenance of the trees. Mr. Newlon advised that <br />procedures would be established to prepare the applicant for success, including directions for care of each <br />of the limited species that would be available. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended approval of Ordinance 18- <br />1483 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1483. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 18-1483 on first <br />reading, as presented. Motion was seconded by Vice Mayor Meadows. <br />Motion carried unanimously by voice vote 4-0. <br />B. Ordinance 18-1485 — Amending Chapter 68 of the City Code of Ordinances <br />Roadway and Utility Construction <br />The City Clerk read Ordinance 18-1485 by title, as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, RELATING TO COMMUNICATION FACILITIES; AMENDING CHAPTER 68, <br />"ROADWAY AND UTILITY CONSTRUCTION" OF THE CITY CODE OF ORDINANCES, BY <br />AMENDING ARTICLE II, "CONSTRUCTION AFFECTING STREETS, RIGHTS-OF-WAY OR <br />EASEMENTS" TO CLARIFY AND UPDATE RIGHTS-OF-WAY UTILIZATION AND PERMIT <br />REQUIREMENTS, AND BY AMENDING ARTICLE IV, "COMMUNICATIONS RIGHTS-OF- <br />WAY", ESTABLISHING NEW REGULATIONS FOR WIRELESS COMMUNICATION <br />FACILITIES AND AMENDING GENERAL CRITERIA FOR COMMUNICATION FACILITIES; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." <br />Staff Presentation: Chief Planner Emily Hanna gave an overview of Ordinance 18-1485, which amends <br />Chapter 68 of the City Code of Ordinances, Road and Utility Construction as it relates to wireless <br />communication facilities. The proposed amendments allow for the City to protect assets within the public <br />rights-of-way while allowing wireless communication facilities to locate within those rights-of-way, and <br />provides certain performance and design criteria for aesthetics while complying with State and Federal <br />regulations. In response to questions from the City Commission, Ms. Hanna advised that she did not have <br />information from other local municipalities to compare with the proposed ordinance for the City of <br />Casselberry; however, she had been in contact with the City of Altamonte Springs and was advised to be <br />aware of companies that were erecting communications facilities without going through the proper <br />procedures for the jurisdiction. She also confirmed that much of the language contained in the ordinance <br />tracked the statutory language exactly. <br />
