BACKGROUND: <br />• On November 21, 2017 the applicant, Tristan Sodom, of Circuit Motorsports, resubmitted a <br />conditional use application for vehicular services, maintenance, and light mechanical repairs for the <br />property located at 290 Iris Road, The conditional use request mss preciously approved by the <br />planning and Zoning Commission on August 10, 2016. <br />• The conditional use has since become null and void beeause nvo of the conditions of the approsal <br />not fulfilled. <br />• Condition 07 of CU 16-12 requires that the conditional use commence nithin 90 days of appmval, <br />and condition 08 states that the conditional use shall expire ifthe use is discontinued for more than 90 <br />days and/or if abusiness tax license is not secured from the (Sty nithin this timef e. <br />• Due to some und reseen delays, the use did not commence and a business tax license mas not <br />obtained iinhin the required tiene[iame. An extension nas not requested by the applicant. <br />CRITERIA FOR CONDITIOAAL USE <br />1. Land use compatibility. Circuit Motorspons is the only use on the subject property. Surrounding <br />properties consist predominantly of commercial uses to the north, south, and -est. The area to the <br />east is comprised primarily of single-family residential homes. Due to the proximity of the subject <br />property to residential homes :long Tulip Trail, one condition of appe-1 will require that the <br />applicant not perform vehicular senio,s, marintemaroe, or light mechanical repairs in the area <br />designated as garage #4 on the survey. With this condition, stag bas determined that the proposed use <br />is compatible pith the suround ng land uses and mill not adversely impact land use activities in the <br />mmediate eicinity. <br />12/14/2017 <br />SCALE AAD INTENS17Y <br />The hours of operation for Circuit Motorsports are Monday -Friday 10:00 am. to 6:00 p.m. The <br />business currently employs five (5) full-time employees and one (1) part-time contract worker. <br />The property has an existing 11,277 square foot building pith four (4) garages to accommodate the <br />CRITERIA FOR COA'DITIOAAL USE <br />2. Sufficientsite sir and adewafe site specifications to accommodate the proposed use. According to <br />Section 115.2 of the ULDR, the site is required to proside 12 regular parking spaces and one (1) <br />ADA space. These figures are based on the requirement that auto repair establishments must proside <br />four (4) spaces per repair stall and the ADA requirements of one (1) ADA space for parkinglots pith <br />20 puking spaces or less. <br />Condition 01 of the precious conditional use appr-1 required the applicant to p—ride 12 regular <br />striped parking spaces and one (1) striped ADA parking space ..site aldrin 30 days. The applicant <br />has since added parking spaces so that there are currently 14 regular striped parking spaces and one <br />(1) striped ADA parking space on the subject property. The amount of parking spaces con the site <br />satisfies the aforementioned condition and the requirements of Sections 3-15.2 and 115.6 of the <br />City's ULDR. <br />3.7'ropnr use of mitiete <br />ztim rhninaes. The applicant shall perform all vehicular services nithin the <br />enclosed building. The applicant shall not staclr or park cars in such a manner that negatively impacts <br />vehicular circulation through rhe property. Going 44 shall not be used to perform vehicular repairs <br />in order to mmimiw the impact oftbis use to the adjacent single-family residential homes. <br />
