Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />April 11, 2018 <br />Page 3 <br />The Commission decided that the following additions/changes would be made to the conditions of approval: <br />1. Replace condition 5 to state: "The business derives at least 51% of gross revenue from the <br />sale of food and non-alcoholic beverages. <br />2. Add condition 14 to state: "The applicant shall not create any nuisances (smoke) with their <br />proposed use to permeate to neighboring uses. <br />Mr. Henson asked the applicant to come forward. Mr. Sami Salama, Florida Curtains, Inc., 378 Tulane <br />Drive, Altamonte Springs, Florida came forward. In response to the Commission's question, Mr. Salama said that he <br />agrees with the conditions of approval. <br />Mr. Walter Judge, property owner, 1531 East Altamonte Drive, Fern Park, Florida came forward. In <br />response to the Commission's question, Mr. Judge said that the applicant is required to have a 51% food component <br />to obtain the alcohol license. Mr. Judge said the business is a Mediterranean cafe that offers the hookah experience. <br />Mr. Judge said that the applicant is planning to add a full kitchen to expand their menu. <br />A brief discussion ensued regarding auditing the percentage of sales for the alcohol license. In response to <br />the Commission's question regarding how other cities regulate this type of business, Mr. Fathelbab said as far as he <br />knows Casselberry is one of the only cities that prohibits bars and lounges in their downtown. He said the City's <br />Community Redevelopment District prohibits bars and lounges. Mr. Fathelbab said that the Planning and Zoning <br />Commission previously approved the conditional use for this business and tonight's agenda item is requesting an <br />extension to that original approval. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 18-08, Mr. Lutz made a motion that the Planning and Zoning <br />Commission approve CU 18-08 to allow for the extension request for on-site consumption of beer and wine (2COP) <br />at 1531 East Altamonte Drive based on the findings of fact and conclusions of the staff report dated April 11, 2018, <br />the staff report dated December 13, 2017, and the thirteen (13) conditions included in the staff report, the addition of <br />condition 14 and modifying Condition 5 to read as the ULDR's states — 51% food and non-alcoholic beverage. Mr. <br />Bakalla seconded the motion. The motion passed with a majority vote with Mr. Phillips and Ms. Hufford casting the <br />dissenting votes. <br />
