Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />April 11, 2018 <br />Page 2 <br />Fifth Item of Business: CU 18-08: 1531 East Altamonte Drive. A conditional use extension request of CU 17- <br />20 to allow the onsite consumption of beer and wine (2COP) located at 1531 East Altamonte Drive. Parcel ID <br />17.21-30-300.009A-0000. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated April 11, 2018. <br />Mr. Fathelbab said the applicant received conditional use approval for on-site consumption from the Planning and <br />Zoning Commission on December 13, 2017. He said the applicant is requesting an extension to allow more time to <br />receive the necessary approvals from the State agencies in order to open the cafe. <br />He said staff recommends the Planning and Zoning Commission approve CU 18-08 to allow for the <br />extension request for on-site consumption of beer and wine (2COP) at 1531 East Altamonte Drive based on the <br />findings of fact and conclusions of the staff report dated April 11, 2018, the staff report dated December 13, 2017, <br />and the following thirteen conditions of approval: <br />1) The conditional use shall be limited to the location of Wanasa Cafe at 1531 East Altamonte Drive. The <br />conditional use does not apply to the other two buildings on the property. <br />2) All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3) Package sales of alcoholic beverages for off-site consumption shall be prohibited. <br />4) The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances. <br />5) Alcohol sales shall not exceed 49% of the total revenues for the business. <br />6) The addition of one (1) ADA parking space and directional arrows indicating the one-way driveways <br />shall be completed with 90 days of the approval. <br />7) There shall be no outside display or storage of goods, materials, services, or vehicles. <br />8) The conditional use shall commence within 90 days of approval. <br />9) All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />10) All signage requires a separate permit and must comply with the ULDR and CRA Urban Design <br />Standards. <br />11) The use shall remain in complete compliance with all City, County and State requirements. <br />12) A new conditional use application shall be required if the use should cease for more than 90 days. <br />13) All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Fathelbab referenced the modification to condition number 6 that was included in Addendum A that was <br />distributed to the Planning and Zoning Commission (a copy is attached and made a part of the minutes). <br />A brief discussion ensued regarding regulation of the percentage of alcohol/food sales required for a 2COP <br />license, the cafe classification and the smoke causing a nuisance to the adjacent businesses. <br />Mr. Van Meter excused himself from the meeting at 6:48 p.m. <br />
