Planning & Zoning Commission/ <br />Local Planning Agency <br />January 10, 2018 <br />Page 5 <br />Planning and Zoning Commission approve CU 17-24 to allow the sale of beer and wine (2COP) for on-site <br />consumption at 500 State Road 436, Suite 1020 based on the staff report dated January 10, 2018, and the twelve <br />(12) conditions of approval outlined in the staff report. <br />In response to the Commission's question, Ms. Hyson stated if the applicant added outside seating it would <br />require conditional use approval. <br />Mr. Henson asked the applicant to come forward. Mr. Robert Sabrkhani, 500 State Road 436, Suite 2018, <br />Casselberry, Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 17-24. Mr. Van Meter made a motion that the Planning and <br />Zoning Commission approve CU 17-24 to allow the sale of beer and wine (2COP) for on-site consumption at 500 <br />State Road 436, Suite 1020, based on the findings of fact and conclusions of the staff report dated January 10, 2018, <br />and the twelve (12) conditions of approval outlined in the staff report including Exhibits A — C. Mr. Bryan seconded <br />the motion. The motion passed unanimously by voice vote. <br />Ninth Item of Business: LPA 17.09 Tree Protection. An ordinance to amend Article XIV, Tree Protection, of <br />the City of Casselberry Unified Land Development Regulations, removing Section 3-14.3(A)(3)(d); modifying <br />Section 3.14.4(A) and Section 3-14.7(G) <br />Mr. Dean Fathelbab, Planner ll, reviewed the information provided in his memorandum dated January 10, <br />2018, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Mr. Fathelbab explained that currently existing <br />trees in older neighborhoods are not protected in the City Code. He explained that homes that have landscape plans <br />are required to obtain a permit to remove any trees and there are no permit requirements for older neighborhoods <br />without landscape plans. Mr. Fathelbab said removal of Section 3-14.3(A)(3)(d) would require a permit for tree <br />removal in the older neighborhoods. He said this code change would allow the City to enforce tree requirements. <br />He said the Tree Bank alternative provides an option to plant trees on private property if the public right of <br />way is not adequate for a large canopy tree.
