It was ordered that the property come into compliance by Ipm, April 12, <br />2018, if the corrections are not made by that time and date a fine of $50.00 per day, per violation for each day the <br />violations continue to exist past April 12, 2018. If Code Compliance finds that compliance has not been achieved <br />by April 12, 2018, a hearing will be held on the same date, 6:30pm at Casselberry City hall. <br />The Special Magistrate advised that the hearings are for code violations, the Magistrate is empowered by the code <br />to make a decision on if there is a code violation. Based on testimony, evidence and photographs that were entered <br />there is no dispute, that is 840 N Triplet Lake Dr, Ms. Pendel is still the owner of record, there is a dead tree, <br />problems with roof maintenance and trash and debris. None of that is in dispute; the law compels the Magistrate <br />to find a violation of the property. The Magistrate continued. <br />The sooner the trustee and the real estate agent get involved and sell the property the better, because the fines will <br />just pile up. This is a code violation and the City has a right to cite it and have a fine and a lien levied against the <br />property, this will encumber the property with another debt that someone buying the property will have to pay <br />off. <br />CE -18-000073 837 ORCHID AVE <br />Construction without a permit, City Code Section 1-4.3 <br />Mark Campbell, Code Compliance Supervisor advised that case number CE -18-000073 located at 837 Orchid <br />Ave, in zoning district Seminole County Zoning, for the violation of Construction without a permit, City Code <br />Section 1-4.3. Notification date was January 15, 2018, correction date requested was January 29, 2018 found non- <br />compliant, hearing notice date was February 20, 2018, correction date requested was March 7, 2018 found Non - <br />Compliant. <br />The property was found to be non-compliant on March 7, 2018. The City requests a correction date of April 12, <br />2018. If no compliance by April 12, 2018 then a fine of $50.00 per day, should then be imposed for each day of <br />non-compliance thereafter. <br />Tim Alcuri, Senior Code Compliance officer advised that this complaint was caled in as an anonymous complaint. <br />Upon inspection on February 20, 2018, the property was found with a lot of work being done to it, January 31, <br />2018 when an inspection was done it was noticed that new flooring was installed, cut out and replaced. February <br />20, 2018, remodeling had been completed. <br />The property manager, Roxy did come in and speak with Mr. Alcuri a week or so prior to the hearing, they were <br />not aware that the work required permits for this type of work in a mobile home and how it works. It was agreed <br />the respondent would move forward and obtain a permit. There was a representative present and a 45 -day <br />compliance time was requested. There is a contractor; they started the work without permits. <br />Samuel Hamilton, 712 Honeysuckle Ln, advised that CPI, the new owner contracted with Bach Development <br />from Tampa, FL. They became aware of the problems after the notices were sent to CPI (Carlisle Property <br />Investors). Roxanna Vidal was not able to make the hearing, she sent Mr. Hamilton (lead maintenance tech). Back <br />Development has been stopped by Roxy to do anything until they obtain permits to go forward. <br />Mr. Hamilton stated he was fine with the Senior Officers recommendation. There are also other contractors who <br />have pulled permits for demolitions. Permits will also be obtained by other contractors to being new models into <br />the park. <br />The Special Magistrate asked if the time recommended was sufficient. <br />4 E a a e <br />
