surrounding businesses and the community, and to protect and advance the public health, safety <br />and welfare; and <br />WHEREAS, the City Commission finds that it is best to confine Medical Marijuana <br />Dispensaries to certain areas of the City where pharmacies are permitted or conditionally <br />permitted, and to separate standalone pharmacies and dispensaries from each other, due to the <br />easier access to opioids and other drugs at these smaller businesses, since ease of access to these <br />drugs have created a public health crisis in the state and this region; and <br />WHEREAS, the City Commission finds the adoption of this Ordinance is in the public <br />interest by serving to promote and protect public health, safety, and welfare and otherwise serves <br />a municipal purpose for the City of Casselberry. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Recitals. The above recitals (whereas clauses) are hereby adopted as the <br />legislative and administrative findings of the City Commission. <br />SECTION IL Part III - Unified Land Development Regulations, Chapter II - District and <br />General Regulations, Article V - Zoning District Regulations, Section 2-5.3, Land Use by Districts, <br />Table 2-5.3, Land Use by District, of the Code of Ordinances of the City of Casselberry, Florida, <br />shall be amended as provided in Exhibit "A" attached and incorporated herein. <br />SECTION III. Part III - Unified Land Development Regulations, Chapter V - Glossary, <br />Article XXL• Language and Definitions, Section 5-21.2, Definition of Terms, of the Code of <br />Ordinances of the City of Casselberry, Florida, shall be amended as follows: <br />Drugstore. An establishment engaged in the sale of non -prescribed medicine and a variety <br />of general products including consumable and non -consumable products includin but not <br />limited to pre-packaged food and beverages, batteries, electronics, beer and wine, toiletries <br />healthcare products, vitamins, nutritional supplements and beauty supplies. <br />Grocery store. An establishment engagedprimarily in the sale of produce and pre-packaged <br />food and beverages. Ancillary sales may include but are not limited to beer and wine <br />tobacco products kitchen and cooking; products beauty products and toiletries vitamins <br />and nutritional supplements gift cards stamps and made or cut to order bakedog ods <br />
