ORDINANCE 18-1479 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE FUTURE LAND USE DESIGNATION FROM SEMINOLE COUNTY MEDIUM DENSITY RESIDENTIAL TO CITY OF CASSELBERRY MEDIUM DENSITY RESIDENTIAL (MDR) FOR THE NEWLY ANNEXED PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE, AND CHANGING THE FUTURE LAND USE DESIGNATION OF ONE PARCEL FROM CITY OF CASSELBERRY LOW DENSITY RESIDENTIAL TO CITY OF CASSELBERRY MEDIUM DENSITY RESIDENTIAL, ALL PARCELS GENERALLY LOCATED ALONG RED BUG LAKE ROAD; PROVIDING FOR TRANSMITTAL OF THE PLAN AMENDMENT TO THE DEPARTMENT OF ECONOMIC OPPORTUNITY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the properties described in Section I were recently annexed into the City of Casselberry corporate boundaries by Ordinance 18-1478, except for one property with a current Future Land Use designation of City of Casselberry Low Density Residential; and WHEREAS, the majority of the properties described in Section I have a Seminole County Future Land Use designation of Medium Density Residential; and WHEREAS, the annexed properties described in Section I need a City of Casselberry Future Land Use designation; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and WHEREAS, properties provided in Section I of this ordinance are greater than 10 acres, requiring a large-scale amendment to the Comprehensive Plan; and WHEREAS, Section 163.3184, Florida Statutes, establishes a process for adoption of comprehensive plans or plan amendments; and WHEREAS, the Planning and Zoning Commission / Local Planning Agency has held a public hearing with due public notice to consider this FLUM amendment; and WHEREAS, a Public Hearing on the question of amending the City of Casselberry Future Land Use Map designations of the properties hereinafter described, has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens for and against the proposed establishment of the City of Casselberry Future Land Use Map designation were heard; and WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, Florida, considered the Comprehensive Plan Amendment and has determined that the Future Land Use designation of said properties provided in Section 1, herein, shall be established as Medium Density Residential, as that designation is defined in Future Land Use Element
