Second Reading of Ordinance 17-1472 — Regulations for Fertilizer Applications <br />The City Clerk read Ordinance 17-1472 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 86, <br />"UTILITIES" OF THE CITY CODE OF ORDINANCES BY ESTABLISHING ARTICLE VII, <br />"FERTILIZER MANAGEMENT"; REGULATING THE PROPER USE OF FERTILIZERS BY <br />ANY APPLICATOR; PROVIDING LEGISLATIVE FINDINGS; PROVIDING DEFINITIONS; <br />PROVIDING FOR APPLICABILITY WITHIN THE CITY OF CASSELBERRY; <br />ESTABLISHING A PROHIBITED APPLICATION PERIOD; SPECIFYING ALLOWABLE <br />FERTILIZER APPLICATION RATES AND METHODS, FERTILIZER -FREE ZONES, LOW <br />MAINTENANCE ZONES, AND EXEMPTIONS; REQUIRING THE USE OF BEST <br />MANAGEMENT PRACTICES WHICH PROVIDE SPECIFIC MANAGEMENT GUIDELINES <br />TO MINIMIZE NEGATIVE SECONDARY AND CUMULATIVE ENVIRONMENTAL EFFECTS <br />ASSOCIATED WITH THE MISUSE OF FERTILIZERS WHICH HAVE BEEN OBSERVED IN <br />AND ON THE CITY OF CASSELBERRY'S NATURAL AND CONSTRUCTED STORMWATER <br />CONVEYANCES, RIVERS, CREEKS, CANALS, LAKES AND OTHER WATERBODIES; <br />REQUIRING PROPER TRAINING OF COMMERCIAL AND INSTITUTIONAL FERTILIZER <br />APPLICATORS; ESTABLISHING TRAINING AND LICENSING REQUIREMENTS; <br />PROVIDING FOR ENFORCEMENT AND PENALTIES; AMENDING SECTION 2-210 <br />"SCHEDULE OF VIOLATIONS" OF ARTICLE V "CODE ENFORCEMENT CITATIONS" OF <br />CHAPTER 2, "ADMINSTRATION", TO PROVIDE FOR PENALTIES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 17-1472 <br />was advertised in the Orlando Sentinel on Thursday, November 9, 2017. <br />Staff Presentation: Natural Resources Officer Marissa Williams gave a brief overview of Ordinance 17- <br />1472, advising the ordinance mirrored the one adopted by Seminole County on February 28, 2017 and was <br />for the purpose of providing new restrictions and regulations regarding fertilizer application within the City <br />of Casselberry with an intent to reduce the impact on water quality to the City's surface waters. In response <br />to questions from the Commission, Ms. Williams advised that the County had received a $100,000 grant <br />from the State of Florida for educational outreach relating to their ordinance and had already begun <br />establishing an extensive amount of website and digital outreach and had scheduled public workshop <br />sessions, and the City of Casselberry would be able to utilize all the educational resources the County had <br />for outreach purposes. She also advised that the City would be utilizing its website and Facebook page for <br />communicating the educational information to the public, and would be updating its Lakes Management <br />Guide and providing those updates to all lakefront property owners should the ordinance be approved and <br />codified. She added that information would be provided at public events, and a speaker had been arranged <br />for Earth Fest to present a workshop relating specifically to the new fertilizer application regulations. She <br />noted that information would be provided to the public in several formats, including email blasts and <br />possibly a flyer included with the monthly utility bills. <br />
