Motion was seconded by Commissioner Solomon. <br />Motion carried unanimously by voice vote 5-0. <br />B. Second Reading of Ordinance 17-1466 — Repealing Section 2-7.34 Medical <br />Marijuana Dispensaries and Medical Marijuana Treatment Centers (LPA 17-05) <br />The City Clerk read Ordinance 17-1466 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY CODE, <br />PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, TABLE 2-5.3, "LAND USE BY <br />DISTRICT" OF ARTICLE V, "ZONING DISTRICT REGULATIONS" TO REMOVE MEDICAL <br />MARIJUANA DISPENSARIES AND MEDICAL MARIJUANA TREATMENT CENTERS AS A <br />CONDITIONAL USE WITHIN THE I (INDUSTRIAL) AND IM (INDUSTRIAL MEDIUM) ZONING <br />DISTRICTS; AND REPEALING SECTION 2-7.34, "MEDICAL MARIJUANA DISPENSARIES AND <br />MEDICAL MARIJUANA TREATMENT CENTERS" OF ARTICLE VII, "GENERAL <br />REGULATIONS"; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 17-1466 <br />was advertised in the Orlando Sentinel on Thursday, August 17, 2017. <br />Staff Presentation: Chief Planner Emily Hanna stated that Ordinance 17-1466 provided for amending the <br />City Code of Ordinances, Part III, Unified Land Development Regulations, Chapter II, District and General <br />Regulations, Article V, Zoning District Regulations, Table 2-5.3, Land Use by District, to remove Medical <br />Marijuana Treatment Centers and Medical Marijuana Dispensaries as a conditional use from both Industrial <br />and Industrial Medium zoning districts, and repealing City Code of Ordinances, Part I1I, Unified Land <br />Development Regulations, Chapter II, District and General Regulations, Article VII, General Regulations, <br />Section 2-7.34, Medical Marijuana Dispensaries and Medical Marijuana Treatment Centers. She advised that <br />no changes had been made to Ordinance 17-1466 since approval on first reading at the July 24, 2017 regular <br />City Commission meeting. <br />Public Hearing: Mayor Glancy stated this was a public hearing to hear and consider comments and questions <br />regarding Ordinance 17-1466. No one came forward to address Ordinance 17-1466. Mayor Glancy closed the <br />public hearing relative to Ordinance 17-1466. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 17-1466 on second reading. <br />MOTION: Commissioner Hufford moved to adopt Ordinance 17-1466 on second and final <br />reading, as presented. Motion was seconded by Vice Mayor Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />
