CASSELBERRY CITY COMMISSION <br />Minutes of February 12, 2018 — Regular Meeting <br />Page 8 of 12 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, EXTENDING A <br />TEMPORARY MORATORIUM FOR NINETY DAYS; PROHIBITING THE OPERATION OF <br />ANY MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN <br />THE CITY OF CASSELBERRY, AND THE ISSUANCE OF BUSINESS TAX RECEIPTS, <br />BUILDING PERMITS, DEVELOPMENT ORDERS OR LAND USE/ZONING PERMITS FOR <br />MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN THE <br />CITY LIMITS IN ORDER TO PROVIDE THE CITY AN OPPORTUNITY TO REVIEW AND <br />ENACT REGULATIONS GOVERNING SAID ACTIVITIES; PROVIDING DEFINITIONS; <br />PROVIDING FOR AN ADMINISTRATIVE REMEDY FOR ASSERTIONS OF VESTED RIGHTS <br />AND PROCESSES AND PROCEDURES RELATING TO SUCH ASSERTIONS; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Emily Hanna gave a brief overview of Ordinance 18-1474, explaining <br />that if approved the ordinance would extend the existing medical marijuana moratorium for an additional <br />90 days. She explained that in 2016, the City of Casselberry had adopted an ordinance which allowed for <br />medical marijuana dispensaries within the City within specific locations and with certain performance <br />criteria; however, in 2017 the Legislature had passed Senate Bill 8A which mandated that municipalities <br />either regulate medical marijuana facilities like pharmacies or ban them outright. She advised that with the <br />passage of Senate Bill 8A the legislation enacted by the City did not meet statutory requirements so the <br />ordinance was repealed by the City Commission and a 180 -day moratorium had been enacted. She further <br />advised that the 180 -day moratorium was set to expire February 24, 2018 and Ordinance 18-1474 would <br />extend it an additional 90 days. She added that staff was currently working on drafting a new ordinance <br />which would allow medical marijuana facilities within the City and which would comply with the statutes, <br />and the extension of the moratorium would allow them time to complete the ordinance and bring it to the <br />City Commission for consideration. In response to questions from the Commission, Ms. Hanna advised <br />that the ordinance would be going to the Planning and Zoning Commission in March and the City <br />Commission could expect to have the ordinance before them to be considered for adoption within the next <br />90 days. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 18-1474 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1474. <br />MOTION: Commissioner Solomon moved to approve Ordinance 18-1474 on first <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />B. Ordinance 18-1475 — Amending Chapter 2, Division 3, Parks & Recreation <br />Advisory Board Membership <br />The City Clerk read Ordinance 18-1475 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 2, <br />ADMINSTRATION, ARTICLE IV, BOARDS, COMMITTEES AND COMMISSIONS, DIVISION <br />
