WHEREAS, pursuant to Executive Order 17 -2345, and Section 252.38(3)(a), Florida <br />Statutes, political subdivisions, such as the City of Casselberry, have the authority to exercise <br />certain powers and authority to safeguard the lives and property of its citizens and community; and <br />WHEREAS, to ensure the protection of the public health, safety, and welfare of the <br />citizens, the City of Casselberry desires to timely and efficiently remove such vegetative and other <br />tree debris throughout the entire City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. State of Emergency. The Declaration of a State of Public Emergency <br />originally confirmed on September 12, 2017, and extended on September 18, 2017, is hereby <br />extended and shall remain in effect until terminated by the City Commission. <br />SECTION 2. Emergency Powers. Pursuant to Executive Order 17 -2345, Section <br />252.38(3)(a), Florida Statutes, and Section 30 -17 of the City Code of Ordinances, the City <br />Commission hereby waives the procedures and formalities otherwise required by the City or by law <br />pertaining to: <br />a. Performance of public work and taking whatever prudent action is necessary to <br />ensure the health, safety and welfare of the community. <br />b. Entering into of contracts. <br />C. Incurring of obligations. <br />d. Employment of permanent and temporary workers. <br />e. Utilization of volunteer workers. <br />f. Rental of equipment. <br />g. Acquisition and distribution, with or without compensation, of supplies, materials <br />and facilities. <br />h. Appropriation and expenditure of public funds. <br />SECTION 3. Purchases and Contracts. The City Commission hereby confirms all <br />purchases and contracts for service that were deemed necessary and approved by the City Manager <br />during the public state of weather emergency and extensions thereof. A contract awarded to <br />CrowderGulf Joint Venture, Inc. for service for tree, brush and associated debris removal and a <br />separate contract awarded to Thompson Consulting Services, LLC for debris monitoring will <br />continue throughout the cleanup period based on contract terms. $2,677.78 for food service support <br />and miscellaneous supplies for staff has been spent to date. Budget Amendment #17-050 for <br />$1,000,000 was considered and approved by the City Commission at a special meeting on Tuesday, <br />September 12, 2017 to fund the City's storm recovery operations. <br />SECTION 4. Conflicts. All prior resolutions or parts of resolutions in conflict herewith <br />are hereby repealed to the extent of the conflict. <br />Resolution 17 -2987 <br />Page 2 <br />
