Section 18 -3 — Bird Sanctuary <br />A. The entire area now embraced within the boundaries known as the corporate limits of <br />the city is hereby designated as a bird sanctuary. <br />B. It is unlawful for any person to take, hunt, kill, maim or trap, or in any manner attempt <br />to hunt, kill, maim or trap or otherwise molest any domestic bird, song bird, migratory bird, <br />wildfowl or waterfowl, except birds or fowl raised in captivity for human consumption. or <br />to rob or otherwise molest the nests or eggs of birds nesting or located within the corporate <br />limits of the city, whether or not such actions result in obtaining possession of the birds or <br />their nests or eggs. This prohibition applies to peafowl, <br />C. The prohibitions of this section shall not apply on property zoned for agricultural use <br />and used for a bona fide agricultural purnose. <br />D. This section will be enforced by the City. <br />SECTION 2: PENALTY. Section 2 -210, Schedule of violations, of Chapter 2, Article V, <br />Code Enforcement Citations, of the Code of Ordinances of the City of Casselberry, Florida, is <br />hereby amended as follows: <br />Sec. 2 -210 — Schedule of violations. <br />(a) Violation of the following City codes or ordinances is a civil infraction for <br />which a citation shall be issued: <br />General City Code <br />Code Section Description of Violation Classification <br />18.3 <br />Taking/trapping etc of birds Class 11 <br />fremainder unchanged] <br />SECTION 3: CODIFICATION. It is the intention of the City Commission of the City <br />of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall <br />become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the <br />Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that the <br />word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION 4: CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any of the provisions of this Ordinance are hereby repealed to the <br />extent of the conflict. <br />Ordinance 17 -1468 <br />
