ORDINANCE 17 -1468 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; CREATING SECTION 18 -3, BIRD SANCTUARY, PART II CODE OF ORDINANCES, CHAPTER 18, ANIMALS, OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, FLORIDA, PROVIDING FOR SANCTUARY FOR BIRDS AND PEAFOWL; PROVIDING FOR PENALTIES; AMENDING SECTION 2 -210, SCHEDULE OF VIOLATIONS, CHAPTER 2, ARTICLE V, CODE ENFORCEMENT CITATIONS, OF THE CODE OF ORDINANCES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry has many lakes and natural areas which attract domestic animals and wildlife and are refuge and homes for these animals; and WHEREAS, it is the desire of the City Commission to protect the numerous bird and peafowl species that call Casselberry home; and WHEREAS, the City has adopted Chapter 20, Animals, of the Seminole County Code of Ordinances; and, by Interlocal, the County has agreed to enforce this code within the City; and WHEREAS, to the extent the City chooses to vary from the County Code or add other regulations, the City will have to provide its own enforcement staff, rather than relying on the County; and WHEREAS, the City Commission finds that providing a sanctuary for birds and peafowl within the City is important to preserving the character of Casselberry, and the City stands ready to enforce this new provision with its own Staff, utilizing the City code enforcement process or civil citations or through the courts; and WHEREAS, words with double underlined tune shall constitute additions to the original text and strike threugh shall constitute deletions to the original text. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The Code of Ordinances of the City of Casselberry, Florida, is hereby amended by adding a new section to be numbered Section 18 -3, `Bird Sanctuary" of Part II — Code of Ordinances, Chapter 18 — Animals, which shall read as follows:
