rights-of-way, are reasonable and non-discriminatory, and are necessary to the management of <br />the public rights-of-way; and <br />WHEREAS, to promote the public health, safety, aesthetics, and general welfare, the <br />City of Casselberry has a substantial interest in maintaining and protecting its public rights-of- <br />way in a non-discriminatory manner, and requiring that individuals and entities seeking permits <br />to conduct any type of excavation, construction or other activity therein do so in a safe, <br />expeditious, and professional manner; and <br />WHEREAS, such public interest extends to protecting, preserving and maintaining the <br />health, safety and welfare of the users of the public rights-of-way, while also protecting, <br />preserving and maintaining the aesthetic character of areas where such rights-of-way exist; and <br />WHEREAS, the City Commission of the City of Casselberry ("City Commission") <br />desires to amend its general permit procedures and guidelines for the utilization of public rights- <br />of-way, to update permitting and registration criteria applicable to communication service <br />providers, communication towers, communication antennas, and wireless communication <br />facilities, and to establish review procedures to ensure that applications for same are acted upon <br />consistent with state and federal law; and <br />WHEREAS, the City Commission has held two public hearings with due public notice to <br />consider the proposed amendments; and <br />WHEREAS, the City Commission hereby finds this Ordinance to be in the best interest <br />of the public health, safety, and welfare of the citizens of the City of Casselberry, Florida, and <br />the general public; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and stfi e thfough type shall constitute deletions to the original text, and asterisks (* * *) <br />Page 2 of 34 <br />
