Planning & Zoning Commission/ <br />Local Planning Agency <br />April 12, 2017 <br />Page 6 <br />8. LPA 17-02: Amending Section 2-7.9 Accessory Structures. An ordinance to amend Section 2-7.9 <br />Accessory Structures to allow accessory structures in easements with conditions. <br />Staff Presentation: Ms. Emily Hanna, Planner 11, reviewed the information provided in staff's memorandum dated <br />April 12, 2017, and gave a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a <br />copy of the PowerPoint presentation is attached to and made a part of these minutes). Ms. Hanna advised that staff <br />requests that the Planning and Zoning Commission recommend approval of LPA 17-02 and hereby amend Section 2- <br />7.9 Accessory Structures, of the City of Casselberry Unified Land Development Regulations, Chapter 11— District and <br />General Regulations, Article VII — General Regulations. <br />A brief discussion ensued regarding the City's Code having previously allowed structures in easement areas and the <br />fact that this proposed amendment would place the burden on the property owner for removal or repair of the <br />structures within the easement in the event it was necessary for a utility provider to get underneath the structure. In <br />response to questions, Ms. Hanna clarified that this amendment would be effect for both existing and future <br />structures. <br />Chairman Henson stated that the applicant for this item was the City so any comments were covered in the staff <br />presentation. <br />Chairman Henson asked if there was anyone in the audience who wished to speak in favor of or in opposition to the <br />requested amendment. The following individuals came forward: <br />1. Mr. John Casselberry, 700 South Lost Lake Lane, expressed some concerns about whether this <br />amendment constituted vacation of an easement, or allowing a structure on top of an easement. <br />Chairman Henson clarified that it was not a vacation, but would allow an accessory structure such as a <br />shed to be constructed on an easement but with certain restrictions, such as permissions from all utility <br />providers and acceptance of responsibility for removal or repairs if necessary. <br />2. Mr. Richard L. Geric, 20 Winding Ridge Road, voiced concerns that this amendment pertained <br />specifically to his property and was advised by Chairman Henson that it was an amendment to the <br />Code which was not property specific. Mr. Geric then shared some issues he had with structures along <br />his and neighboring property lines. Chairman Henson advised him again that this item was not property <br />specific and was a Planning and Zoning issue, and that for the issues he described he should contact <br />the City's code enforcement staff. <br />MOTION; Ms. Campbell moved that the Planning and Zoning Commission recommend <br />approval of LPA 17-02 and hereby amend Section 2-7.9 Accessory Structures, of <br />the City of Casselberry unified Land Development Regulations, Chapter 11- District <br />and General Regulations, Article VII — General Regulations. <br />Motion was seconded by Mr. Bryan. Motion passed unanimously by voice vote. <br />Chairman Henson recessed the meeting at 7:24 p.m, and reconvened the meeting at 7:39 p.m. <br />9. Other Business: Comprehensive Plan Workshop with Consultants <br />Ms. Lucie Ghioto, Senior Planner and Project Manager with Poulos and Bennett, 2602 East Livingston Street, <br />Orlando, introduced project team members who were present, including Mr. Marc Stehli, Engineering Team Leader <br />with Poulos and Benneft, Ms. Laura Turner of Laura Turner Planning Services, and Ms. April Fisher with Fisher <br />
