CONTINUED CASE <br />Illegal land use; ULDR Section 2-4.5 & 2-5.3 <br />Operating without a BTR; City Code Section 26.33 <br />Non -permitted signs, ULDR Section 3-16.8 is complied <br />CE -16-001161 Vacant/Lakeview Dr <br />Mark Campbell, Code Compliance Supervisor advised that case number CE -16-001161 for violation Address: <br />Vacant/Lakeview Dr, in zoning district: CG for the violation of illegal land use; ULDR Section 2-4.5 & 2-5.3, <br />operating without a Business Tax Receipt; City Code Section 26.33 and non -permitted signs; ULDR Section 3- <br />16.8 (is complied). The notification date was January 30, 2017, correction date requested was February 14, 2017 <br />found non-compliant. The hearing notice date was February 15, 2017, the correction date requested: April 12, <br />2017 found non-compliant, continuation date was May 11, 2017. <br />This case was first heard on April 13, 2017 and continued to May 11, 2017. The property was found to be non- <br />compliant on May 11, 2017. The City requests a correction date of July 11, 2017. If no compliance by July 11, <br />2017 then a fine of $100.00 per day, should be imposed for each day of non-compliance thereafter. <br />Mr. Campbell described photographs, Facebook page and a flyer. <br />The Special Magistrate advised (for the record) the property zoned commercial general and outdoor storage is <br />not permitted. <br />Emily Hanna, Planner with City of Casselberry advised that the City has had multiple conversations with Mr. <br />Vandestreek since the hearing on April 13, 2017; unfortunately there is nothing the City can do at this time. <br />Different options were looked at but none were viable for Mr. Vandestreek. Questions have been asked about <br />other uses on the property. This property is also in the CRD, which also prohibits outdoor storage. <br />The Special Magistrate stated, outside storage is prohibited in two ways. He then asked what about the business <br />tax receipt. <br />Ms. Hanna stated the business tax receipt could not be issued, because planning would have to sign off that the <br />use is allowed in both districts and they could not. <br />The Special Magistrate called for the property owner and then swore him in. <br />David Vandestreek, 2818 Lakeview Dr. advised that the State told him he could use the property for a parking <br />lot, there is also drainage going through the parking lot. Mr. Vandestreek also stated he had gone to the City <br />planning Department to ask if he can park cars overnight, he was told yes just as long as he didn't charge any <br />money. He also asked if a 6 ft. fence could be put up, with two gates, there was a permit. Mr. Vandestreek <br />continued. <br />The Special Magistrate asked to see a copy of the building permit. <br />Mr. Vandestreek stated they had one copy <br />The Special Magistrate asked is it Mr. Vandestreek testimony that he is not charging any money for the vehicles <br />to be there. <br />Mr. Vandestreek stated that was right. <br />31 Page <br />
