(b) Each day that a narking violation occurs or continues will constitute a <br />separate offense for which -a narking citation may be issued. <br />c) Citations issued in a form approved by the Chief of Police pursuant to <br />Section 82-53 for parking violations may be issued by police officers, or any other <br />person successfully completing the applicable state requirements, as designated <br />by the City Manager and approved by the Chief of Police. <br />SECTION V. Amendment of Section 82-72 of the City Code. That Section 82-72 <br />"Failure to respond to citation" of Division 3, "Enforcement of Parking Regulations" of Article <br />II, "Administration and Enforcement" of Chapter 82, "Traffic and Vehicles" of the Code of <br />Ordinances of the City of Casselberry, Florida, is hereby amended to read as follows: <br />Sec. 82-72. — Payment of fines: Failure to respond to citation. <br />■. <br />Oa The operator or registered owner of a vehicle receiving a parking citation for <br />a parking violation shall, within fourteen (14) business days, pay the fines as <br />prescribed in this chapter or request a hearing before a judge of the county <br />court. Any person electing to appear before the designated judge shall be <br />deemed to have waived his right to pay the civil penalty. The judge, after a <br />hearing, shall make a determination as to whether a violation has been <br />committed. If the commission of violation has been proven, the judge may <br />impose a fine not to exceed $100.00 plus court costs. <br />bW Failure of the owner or operator of the vehicle to make payment of the fine <br />within fourteen (14) business days from the date the narking citation was <br />issued shall render such owner or operator subject to maximum prosecution <br />under state law at the discretion of the court and a late charge of S10.00 <br />"initial late charge") unless such person timely requests a hearing. Failure to <br />make payment of the fine within thirty (30) days shall subject such owner or <br />operator to an additional late charge of $10.00 ("additional late charge").
