PETITION .• • CLOSE, VACATE 1 ♦ , 1 ♦ , • EASEMENT To: City of Casselberry City Commission The undersigned Petitioner respectfully petitions this Commission to close, vacate, abandon, discontinue, disclaim and to renounce any right of the City of Casselberry, a political subdivision, in the State of Florida, and the public in and to the following described easement, to wit: Description: A portion of Lot 38, Block "B", Summerset North according to the plat thereof recorded in Plat Book 15, Pages 13-14, Public Records of Seminole County, Florida, being more particularly described as follows: Commence at the Northeast corner of Lot 38, Block "B", Summerset North according to the plat thereof recorded in Plat Book 15, Pages 13-14, Public Records of Seminole County, Florida; thence South 89009'58" West, a distance of 25.58 feet, along the North line of said Lot 38; thence departing said North line South 00°50'02" East, a distance of 2.71 feet to the POINT OF BEGINNING; thence South 00014'01" East, a distance of 4.29 feet to a point on the South line of a 7.00 foot wide utility easement as shown on said plat; thence South 89009'58" West, a distance of 14.76 feet, along the South line of said 7.00 foot wide utility easement; thence departing said South line North 00°14'01" West, a distance of 4.44 feet; thence North 89045'59" East, a distance of 14.76 feet to the POINT OF BEGINNING. Your Petitioner would show that the said easement has not been used by the City of Casselberry. Petitioner constitutes a majority of the abutting property owners desiring the easement to be closed, vacated and abandoned. Petitioner would further submit that the closing, vacating, abandoning, renouncing and disclaiming of any rights of the City of Casselberry, Florida and the public in and to any land in connection with the said easement described hereinabove will not be detrimental to the public or to the property of any person or persons, but, in fact would be beneficial to the pubic. WHEREFORE, Petitioner requests this Commission to schedule a public meeting at the earliest practicable date for the purpose of considering the vacation, closing and abandoning of the easement described above.
