RESOLUTION 17-2944 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />PARTIAL CLOSING, VACATION, AND ABANDONMENT OF A 7' <br />UTILITY EASEMENT ON PARCEL ID NUMBER 21-21-30-504-01100-0380, <br />LOT 38, BLOCK B, OF SUMMERSET NORTH, AS RECORDED IN PLAT <br />BOOK 15, PAGE 13, PUBLIC RECORDS OF SEMINOLE COUNTY, <br />FLORIDA; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, on January 31, 2017 a petition was filed with the City Commission of the <br />City of Casselberry, Florida to close, vacate, and abandon a 3' x 12' portion of a 7' utility <br />easement on Parcel ID number 21-21-30-504-01300-0380, Lot 38, Block B, Summerset North <br />(121 Mark David Boulevard) as recorded in Plat Book 15, Page 13, Public Records of Seminole <br />County, Florida; and <br />WHEREAS, the City Commission finds that completely closing, vacating, and <br />abandoning the section of aforesaid easement, including renouncing any public rights of ingress <br />and egress, will not present a detriment to either the City of Casselberry, Florida, or the public. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />closing, vacation, and abandonment of a 3' x 12' portion of the 7' utility easement on Parcel ID <br />number 21-21-30-504-0BOO-0380, Lot 38, Block B, Summerset North (as described in Exhibit `A' <br />attached) and recorded in Plat Book 15, Page 13, Public Records of Seminole County, Florida, <br />and authorizes the Mayor to sign this resolution on behalf of the City Commission. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
