Funds for the City Labor Attorney's invoice are available in FY 2017 Budget Account No. 001-0140-514.31-02. Recommendation: The City Manager and staff recommended approval of the legal services invoices as submitted. C. Resolution 16-2928 — Sovereignty Submerged Lands Easement "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, ACCEPTING A SOVEREIGNTY SUBMERGED LANDS EASEMENT FROM THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA THROUGH THEIR AGENT, THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Introduction: Resolution 16-2928 accepts the Sovereignty Submerged Lands Easement from the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida through their agent, the Florida Department of Environmental Protection, and authorizes the Mayor to execute said document on behalf ofthe City. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Public Works Director recommended approval of Resolution 16-2928. D. Resolution 16-2929 — Contingency change Order No. 5 with Wharton -Smith Related to the Lake Concord Park Project & Related Budget Amendment #17-016 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING THE USE OF CONTINGENCY FUNDS AND AUTHORIZING THE EXECUTION OF CONTINGENCY CHANGE ORDER NO. 005 FOR MISCELLANEOUS CONSTRUCTION ISSUES RELATED TO THE LAKE CONCORD PARK AND TRIPLET LAKE DRIVE SIGNATURE STREET PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Introduction: Resolution 16-2929 approves the use of available GMP (Guaranteed Maximum Price) over-all proj ect contingency funds of $192,993.95, related specifically to the eight contingency fund requests listed in Contingency Change Order No. 005 in the total amount of $106,888.43 for construction issues related to the Lake Concord Park and Triplet Lake Drive Signature Street Projects, and authorizes the Mayor to execute said document on behalf of the City. Consideration of related Budget Amendment # 17-016 is also requested. Budget Impact: Approval of Budget Amendment #17-016 will affect the Mass Grading/Park Area (CCI 504), Triplet Lake Drive Realignment (CC 1501), Signature Street (CCI 505) and Public Works (CCI 502) projects. A copy of the schedule detailing the affected accounts and amounts is attached to and made a part of these minutes.
