Finding of fact -The Special Magistrate made a finding that this case came before the Special Magistrate on <br />October 13, 2016. Based on evidence entered it was found that there was a violation of ULDR Section 3-10.3 C <br />4, obstructing the Public Right of Way. The violation occurred between June 14, 2016 and July 7, 2016, as of <br />October 13, 2016 the property was no longer in violation and was in compliance. A Standing Order was entered <br />that if the property violates the same ULDR Section, it would be treated as a repeat violation and a fine of up to <br />$500 per day may be imposed that the violation exists. <br />Barbara Cifelli, 36814 Wolf Ct, Eustis, FL gave testimony. Ms. Cifelli thanked the City for the reduction but <br />asked for a total reduction. Paula Noack passed away on October 20, 2016, she had been diagnosed with <br />melanoma cancer and that affected her mentally. <br />The Special Magistrate asked if Ms. Noack lived at the house. <br />Ms. Cifelli stated she did before the house caught fire after an electrical issue. Ms. Cifelli stated her mother kept <br />extending the permit so she could recycle all the materials. <br />Gwyn Noack, 3190 N Atlantic Ave, Cocoa Beach, FL gave testimony. Ms. Noack stated their mother was <br />mentally ill, which was part of her insistence on extending the removal of the house for as long as she could. <br />Her mother had lived at the home for 30-40 years. <br />Finding of Fact: The Special Magistrate made a finding in case # CE -15-00042, 240 Aurora Cir, and <br />Casselberry, FL. It looked like originally this cause had come before the Special Magistrate on February 11, <br />2016, the cause being the Notice of Violation General Maintenance violation ULDR Section 3-10.3. On July 14, <br />2016 a fine was imposed on the property for the violation. Given the amount of time that went through, the <br />Magistrate did not think there was enough justification to bring the fine to zero but 10% seemed reasonable. It <br />was ordered that the fine be reduced to $330.00 which is 10% of what it was originally. The reduced fine needs <br />to be paid within 60 days then the full amount will become due. <br />OTHER BUSINESS <br />The Special Magistrate asked if there was any other business to discuss. <br />There was no other business. <br />PUBLIC COMMENT <br />The Special Magistrate asked if there were any public comments.
