The factors used to consider the red, on request are, there have not been ar Aher violations on the property, <br />the violation did come into compliance after obtaining a permit from the Public Works Department, the <br />homeowner spent $3,823 to remediate the violation, the homeowner states there was an erosion problem on the <br />property. <br />The Special Magistrate asked if the owners or representatives for 945 Brydie Ct were present. The owner was <br />present. <br />David Pieski, 945 Brydie Ct; Casselberry, FL stated he had requested a complete waiver of the lien, based on <br />the fact that he was given a construction permit by Phyllis Wallace. The City maintained that Mr. Pieski brought <br />in excess fill dirt at the upper edge of the 100 year floodplain after the sea wall was constructed. Subsequent <br />work with the City, specifically, Kelly Brock, required multiple revisions and multiple potential options to <br />rectify the problem. Some of the problems included, ripping out the wall completely or removing half of the <br />wall, left side or right side. <br />There were also many parties involved, per the City directive, Northshore Courtyard Villas HOA, Florida <br />Department of Environmental Protection, Reggie Caruso (City of Altamonte Springs), plus the engineering firm <br />that Mr. Pieski hired per Kelly Brock's directive. Mr. Pieski felt a complete reduction/waiver was in order, <br />because once he applied for a variance and was denied he worked in good faith, in due diligence to rectify the <br />problem, as there were many moving parts, many sign -offs, many permissions that has to be acquired. Mr. <br />Pieski stated HOA's don't operate under his schedule, they operate on a monthly meeting basis and whether <br />they had gotten to his issue, he can't force the issue to a Board of Directors at an HOA. <br />A requirement by Kelly Brock was that all permissions be granted by the HOA be granted prior to any <br />subsequent permit or building permit and that was the basis for the complete waiver request. <br />The Special Magistrate asked if Mr. Pieski had a copy of the permit that was referred to earlier. <br />Mr. Pieski stated he did and the letter he also submitted, on the first page it was reference from Ms. Lipscomb, <br />specifically refers to the permit granted by Casselberry from Ms. Wallace which re -enforces his point. <br />The special Magistrate asked if there was anything else. Mr. Pieski had nothing else. <br />Mr. Campbell advised that the City's position was still the reduction to $6,690 plus $950 (administrative cost) <br />for a total of $7,640. <br />The Special Magistrate asked what the date of the original finding was. <br />Mr. Campbell was not aware of the date. <br />The Special Magistrate asked how many days the fine had accrued over. <br />Mr. Campbell advised that he did not have that information with him. <br />The Special Magistrate advised that his rough calculation was 3 and 2/3 years. <br />Mr. Campbell advised that is was his understanding it was for about 4 years. <br />The Special Magistrate asked the City for a timeline. <br />4 1 P a g e <br />
