Ms. Bowles stated that was correct. <br />The Special Magistrate asked Ms. Bowles if August 10, 2016 gives enough time to get the permit. <br />Ms. Bowles stated yes. <br />Nathan Johnson, Code Compliance Officer stated the permits were applied for. The current fence/gate exceeds <br />the three foot limit and a variance needs to be applied for. The meeting for the variance would be on July 13, <br />2016, the August 10, 2016 date would give time for either taking the fence down or shortening it. <br />Ms. Bowles stated she understood what the City was saying. The fence/gate was put up because people kept <br />making U-turns in the driveway. <br />The Special Magistrate advised that what the City was saying is that even if she had gotten a permit a variance <br />would be needed because the fence/gate was too tall. <br />Finding of Fact- Based on the testimony and photographs entered into evidence and the homeowner's <br />acknowledgement, the fence/gate was built without a permit. It was found that in case CE -16-00093, property <br />address 55 N Winter Park Dr to be in violation of fence erected without permit; ULDR Section 2-7.10(A). It <br />was ordered that the property come into compliance August 10, 2016, if the property is not in compliance by <br />that date a fine of $50.00 per day for each day of non-compliance would begin to accrue. If the Code <br />Enforcement Officer finds compliance has not been achieved by August 10, 2016 another hearing will be held <br />on August 11, 2016 to determine compliance. <br />Tence erected without permit; ULDR Section 2-7.10(A) <br />® CE -16-00120 1157 Galahad Dr <br />Mark Campbell, Lead Code Compliance Officer read the case history into record, case number CE -16-00120, <br />violation address 1157 Galahad Dr, violation; Parking business related vehicle ULDR Section 3-10.9. <br />Commercial vehicle being parked or stored at this residential property. Notification date April 6, 2016, <br />correction date requested: April 17, 2016 (non-compliant), hearing notice date May 19, 2016, property <br />posted/served May 19, 2016 (hand served), correction date requested: June 8, 2016 (vehicle not present). The <br />property was found to be in compliance on June 8, 2016. However, the City requests a Standing Order for any <br />future violation of the same code, due to the property being found out of compliance on April 6, 2016, April 30, <br />2016, and May 19, 2016, with no fine being imposed at this time. <br />The Special Magistrate viewed photos provided in the PowerPoint presentation <br />Nathan Johnson, Code Compliance Officer advised that he has spoken to the property owners about this and <br />given them the requirements on how this needs to be resolved. The property owner agreed to remove the ladder <br />racks and buy'magnetie covering, which he has shown Mr. Johnson a picture prior to this meeting. The covers <br />would cover the lettering. The property owner has been informed that the City was going to request a Standing <br />Order and any future repeat violation could result in a fine being imposed on the vehicle. <br />The Special Magistrate called to the audience for the property owner of 1157 Galahad Dr. The owner was <br />present. <br />.uis Ramirez, 1157 Galahad Dr advised that the first time he had the vehicle covered in the picture with a full <br />size cover, he was told by the first Code Enforcement Officer that came by that the cover was ok as long as <br />41 Page <br />
