Resolution 16 -2851 — Bainbridae Casselberry Final Replat SP 16 -02) The City Cleric read Resolution 16 -2851 by title as follows: "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING THE `BAINBRIDGE CASSELBERRY REPLAT"; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." Staff Presentation: Development Services Manager Randy Woodruff advised that the applicant, CO -BB Casselberry Venture, LLC was requesting approval of a final replat for the proposed luxury apartment complex Bainbridge Casselberry Apartments. He further advised that the applicant was scheduled to close on the subject property by May 12, 2016; the City would hold a title certification letter until the closing; and the plat would be recorded after closing. He stated that the City Manager and the Community Development Director were recommending approval of the final replat subject to the following conditions: CO -BB Casselberry Venture, LLC shall close on the subject property no later than May 12, 2016; CO -BB Casselberry Venture, LLC shall provide the City Attorney the OR Book and Page number of the Special Warranty Deed to be placed on the Title Certification Letter; If closing does not take place, the final replat shall become null and void. Mr. Woodruff then advised that staff and the developer were available should the Commission have any questions. Mr. Marls Thompson of the law firm Shutts & Bowen LLP, 300 South Orange Avenue, Suite 1000, Orlando, FL, advised that he represented CO -BB Casselberry Venture, LLC. He expressed appreciation to staff and the City Attorney for the support they had provided throughout the process, and stated that the applicant was in agreement with the recommendations presented. He explained that the adjustment made to set the closing date by May 12, 2016 gave the cushion needed to complete obtaining some third party easements. He added that it was possible they would close sooner than the May 12t" date, but he would keep the City advised. He stated that he was available for any questions ftom the Commission. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended approval of Resolution 16 -2821 - Bainbridge Casselberry Final Replat (SP 16 -02) subject to the following conditions: 1. CO -BB Casselberry Venture, LLC shall close on the subject property no later than May 12, 2016. 2. CO -BB Casselberry Venture, LLC shall provide the City Attorney the OR Book and Page number of the Special Warranty Deed to be placed on the Title Certification Letter. 3. If closing does not take place, the final replat shall become null and void.
