Resolution 16 -2851 — Bainbridae Casselberry Final Replat SP 16 -02) <br />The City Cleric read Resolution 16 -2851 by title as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />APPROVING THE `BAINBRIDGE CASSELBERRY REPLAT"; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: Development Services Manager Randy Woodruff advised that the applicant, CO -BB <br />Casselberry Venture, LLC was requesting approval of a final replat for the proposed luxury apartment <br />complex Bainbridge Casselberry Apartments. He further advised that the applicant was scheduled to close on <br />the subject property by May 12, 2016; the City would hold a title certification letter until the closing; and the <br />plat would be recorded after closing. He stated that the City Manager and the Community Development <br />Director were recommending approval of the final replat subject to the following conditions: <br />CO -BB Casselberry Venture, LLC shall close on the subject property no later than May 12, <br />2016; <br />CO -BB Casselberry Venture, LLC shall provide the City Attorney the OR Book and Page <br />number of the Special Warranty Deed to be placed on the Title Certification Letter; <br />If closing does not take place, the final replat shall become null and void. <br />Mr. Woodruff then advised that staff and the developer were available should the Commission have any <br />questions. <br />Mr. Marls Thompson of the law firm Shutts & Bowen LLP, 300 South Orange Avenue, Suite 1000, Orlando, <br />FL, advised that he represented CO -BB Casselberry Venture, LLC. He expressed appreciation to staff and the <br />City Attorney for the support they had provided throughout the process, and stated that the applicant was in <br />agreement with the recommendations presented. He explained that the adjustment made to set the closing <br />date by May 12, 2016 gave the cushion needed to complete obtaining some third party easements. He added <br />that it was possible they would close sooner than the May 12t" date, but he would keep the City advised. He <br />stated that he was available for any questions ftom the Commission. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Resolution 16 -2821 - Bainbridge Casselberry Final Replat (SP 16 -02) subject to the following conditions: <br />1. CO -BB Casselberry Venture, LLC shall close on the subject property no later than May 12, <br />2016. <br />2. CO -BB Casselberry Venture, LLC shall provide the City Attorney the OR Book and Page <br />number of the Special Warranty Deed to be placed on the Title Certification Letter. <br />3. If closing does not take place, the final replat shall become null and void. <br />
