Second Reading of Ordinance 16 -1439 — Medical Marijuana Regulations for <br />Dispensaries and Treatment Centers <br />The City Clerk read Ordinance 16 -1439 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY CODE, <br />PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, TABLE 2 -5.3, LAND USE BY <br />DISTRICT, TO ALLOW MEDICAL MARIJUANA DISPENSARIES AND MEDICAL MARIJUANA <br />TREATMENT CENTERS AS A CONDITIONAL USE WITHIN THE I (INDUSTRIAL) AND IM <br />(INDUSTRIAL- MEDIUM) ZONING DISTRICTS; AMENDING ARTICLE VII "GENERAL <br />REGULATIONS" TO ADD SECTION 2 -7.34 FOR MEDICAL MARIJUANA DISPENSARIES AND <br />MEDICAL MARIJUANA TREATMENT CENTERS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 16 -1439 was published in the <br />Orlando Sentinel on Thursday, March 31, 2016. <br />Staff Presentation: Planner Emily Hanna advised that Ordinance 16 -1439 had been presented to the <br />Commission for first reading on March 14, 2016 and there had been no changes made to the ordinance since <br />that time. She further advised the purpose of Ordinance 16 -1439 was to regulate the siting and community <br />impact of medical marijuana dispensaries and medical marijuana treatment centers within the city limits. She <br />stated that staff was available for any questions the Commission might have. City Attorney Reischmann shared <br />some information from a webinar in which she had participated regarding the status of medical and recreational <br />marijuana in the various states, noting that some issues had arisen with banks' acceptance of funds from sales <br />of the marijuana due to the residual odor on the currency, and with economic development in the areas in <br />which the marijuana growing facilities were being located. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 16 -1439 on second reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 16 -1439. No one came <br />forward to address Ordinance 16 -1439. Mayor Glancy closed the public hearing relative to Ordinance 16- <br />1439. <br />MOTION: Vice Mayor Hufford moved to adopt Ordinance 16 -1439 on second and final <br />reading, as presented. Motion was seconded by Commissioner Solomon. <br />Motion carried unanimously by voice vote 5 -0. <br />
