CASSELBERRY CITY COMMISSION <br />Minutes of March 14, 2016 — Regular Meeting <br />Page 8 of 14 <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Development Services Manager Randy Woodruff gave an overview of proposed <br />Ordinance 16 -1440, explaining that the ordinance would provide specific amendments to Chapter 10 of the <br />City Code of Ordinances relating to alcoholic beverages. He further explained that the proposed amendments <br />defined "educational institution" to clarify distance separations required from establishments serving alcohol; <br />defined "bottle clubs"; prohibited "bottle clubs" within the City limits; and repealed Sections 10 -4 and 10 -6 <br />which contained archaic language establishing closing times for liquor sales on New Year's Eve and <br />advertisement of Sunday sales of alcoholic beverages within the City. He then distributed information <br />containing data relating to crime statistics involving bottle chubs. <br />City Attorney Katie Reischmann clarified that the information distributed by Mr. Woodruff included statistics <br />gathered by law enforcement agencies and supported staff findings that there was more crime associated with <br />bottle chubs. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 16 -1440 on first reading. <br />Audience Participation: No one came forward to address Ordinance 16 -1440. <br />MOTION: Vice Mayor Hufford moved to approve Ordinance 16 -1440 on first reading, as <br />presented. Motion was seconded by Commissioner Solomon. Motion carried <br />unanimously by voice vote 5 -0. <br />C. Ordinance 16 -1441 — Charter Amendments <br />The City Clerk read Ordinance 16 -1441 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, SUBMITTING TO THE <br />ELECTORS OF CASSELBERRY PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY <br />OF CASSELBERRY AT THE REGULAR CITY ELECTION TO BE HELD AUGUST 30,2016; <br />PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE PROPOSED CHARTER <br />AMENDMENTS; PROVIDING FOR THE CALL OF A REFERENDUM ELECTION; PROVIDING <br />FOR DIRECTION TO THE CITY CLERK; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />CODIFICATION, EFFECTIVE DATE OF ORDINANCE AND AN EFFECTIVE DATE FOR THE <br />APPROVED AMENDMENTS." <br />Staff Presentation: City Manager Randy Newlon reminded the Commission that at the January 25, 2016 <br />regular Commission meeting they had heard and discussed potential charter referendum questions to bring to <br />the voters proposing modification to the City's Charter in several different areas. He explained that staff had <br />taken guidance from those discussions and prepared Ordinance 16 -1440 for Commission consideration. He <br />then asked City Attorney Katie Reischmann and City Clerk Donna Gardner to provide additional details, if <br />needed. <br />
