Staff Presentation: Development Services Manager Randy Woodruff gave an overview of proposed Ordinance 16 -1440, explaining that the ordinance would provide specific amendments to Chapter 10 of the City Code of Ordinances relating to alcoholic beverages. He further explained that the proposed amendments defined "educational institution" to clarify distance separations required from establishments serving alcohol; defined "bottle clubs"; prohibited "bottle clubs" within the City limits; and repealed Sections 10 -4 and 10 -6 which contained archaic language establishing closing times for liquor sales on New Year's Eve and advertisement of Sunday sales of alcoholic beverages within the City. He then distributed information containing data relating to crime statistics involving bottle chubs. City Attorney Katie Reischmann clarified that the information distributed by Mr. Woodruff included statistics gathered by law enforcement agencies and supported staff findings that there was more crime associated with bottle chubs. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended approval of Ordinance 16 -1440 on first reading. Audience Participation: No one came forward to address Ordinance 16 -1440. MOTION: Vice Mayor Hufford moved to approve Ordinance 16 -1440 on first reading, as presented. Motion was seconded by Commissioner Solomon. Motion carried unanimously by voice vote 5 -0. C. Ordinance 16 -1441 — Charter Amendments The City Clerk read Ordinance 16 -1441 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, SUBMITTING TO THE ELECTORS OF CASSELBERRY PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF CASSELBERRY AT THE REGULAR CITY ELECTION TO BE HELD AUGUST 30,2016; PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE PROPOSED CHARTER AMENDMENTS; PROVIDING FOR THE CALL OF A REFERENDUM ELECTION; PROVIDING FOR DIRECTION TO THE CITY CLERK; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, EFFECTIVE DATE OF ORDINANCE AND AN EFFECTIVE DATE FOR THE APPROVED AMENDMENTS." Staff Presentation: City Manager Randy Newlon reminded the Commission that at the January 25, 2016 regular Commission meeting they had heard and discussed potential charter referendum questions to bring to the voters proposing modification to the City's Charter in several different areas. He explained that staff had taken guidance from those discussions and prepared Ordinance 16 -1440 for Commission consideration. He then asked City Attorney Katie Reischmann and City Clerk Donna Gardner to provide additional details, if needed.
