CASSELBERRY CITY COMMISSION <br />Minutes of August 10, 2015 — Regular Meeting <br />Page 12 of 15 <br />Mayor Glancy asked for clarification as to whether the street name was Carriage Hill Drive or Carriage Hill Circle, <br />as it was listed as Circle on the agenda and as Drive in the resolution. Construction and Permitting Manager <br />Marty Pawlikowski confirmed it was Circle, and Ms. Gardner asked that any motion by the Commission reflect <br />an amendment to the title and body of the resolution to read correctly as Carriage Hill Circle. <br />Staff Presentation: Construction and Permitting Manager Marty Pawlikowski briefly explained the residentat46 <br />Carriage Hill Circle wished to refinance the home and it was discovered that when built in 1968, the house had <br />been constructed within an easement. He stated that in order to refinance the home, the homeowner would either <br />have to remove the portion of the home within the easement, or obtain a vacation of the easement. He explained <br />that staff had come up with a solution that involved vacating three feet of the easement, which would be the <br />portion on which the home encroached. He added that there is a storm pipe in the easement, but the vacation of <br />the three feet would leave sufficient room to maintain the utility. He further added that he had letters from the <br />other utility companies utilizing the easement and there was no objection to the vacation of the three feet. He <br />stated that staff was recommending approval of the vacation. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution 15- <br />2759. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Resolution 15 -2759. No one came forward. <br />Mayor Glancy closed the public hearing relative to Resolution 15 -2759. <br />MOTION: Commissioner Aramendia moved to approve Resolution 15 -2759, as amended to <br />reflect 46 Carriage Hill Circle instead of 46 Carriage Hill Drive throughout the <br />resolution. Motion was seconded by Commissioner Hufford. Motion carried <br />unanimously by voice vote 5 -0. <br />B. Second Reading of Ordinance 15 -1427 — Le agcy Park Planned Development Master <br />Land Use Plan Amendment <br />The City Clerk read Ordinance 15 -1427 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE LEGACY PARK PD MASTER PLAN (66.83 +/- ACRES AS DESCRIBED IN THIS <br />ORDINANCE), GENERALLY LOCATED ON SEMINOLA BOULEVARD IN CASSELBERRY, FLORIDA, <br />FOR THE PURPOSE OF CHANGING THE CURRENT APPROVED LAND USES WITHIN THE MASTER <br />PLAN BY RELOCATING THE GENEVA SCHOOL AND REPLACING THE COMMERCIAL CENTERS <br />AND APARTNWISTS WITH RESIDENTIAL HOMES; PROVIDING IDENTIFICATION OF PROPERTY <br />WITHIN THE CITY OF CASSELBERRY AUTHORIZED FOR INCLUSION IN SAID AMENDMENT; <br />PROVIDING FOR PERIOD OF EFFECTIVENESS; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br />
