Planning & Zoning Commission( <br />Local Planning Agency <br />December 9, 2015 <br />Page 4 <br />Ninth Item of Business: LPA 15.09: Medical Marijuana Ordinance. An ordinance creating standards for medical <br />marijuana treatment centers in the City of Casselberry. <br />Ms. Emily Hanna, Planner I, reviewed the information provided in staff's memorandum dated December 9, 2015, <br />and a PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy is attached and made a <br />part of the minutes). Ms. Hanna said she would like to review this as a workshop item. She said she would take the items <br />discussed this evening and bring it back to the Commission at a later date for their review. Addendum #3 was distributed to <br />the Planning and Zoning Commission (a copy is attached and made a part of the minutes). <br />Ms. Hanna summarized the following items for discussion: hours of operation, adding language to prohibit use of <br />medical marijuana on public property, prohibiting cultivation in the City, building size criteria, signage regulations and <br />conditional use approval time frame and renewal. <br />A lengthy discussion ensued regarding signage limitations, additional regulations required for medical marijuana <br />dispensaries, licensing requirements for facilities, hours of operation, allowing drive -thru windows, possible locations and <br />distance separations, completely restricting locations in the City, the state's regulations, prohibiting medical marijuana use <br />on public property, seating requirements and the restriction of sale of other items in the dispensaries. <br />In response to the Commission's question, Ms. Hanna said she would provide the updated "White Paper" <br />information with the next review of this item. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />A brief discussion ensued regarding the employee background check through the state's database, possibly adding <br />a federal database background check and the Police Department Safety and Security Plan. Captain David DelRosso, Police <br />Department, explained that a felony can be different from state to state. <br />A general discussion ensued regarding cultivation regulations, fees charged by the City for medical marijuana <br />dispensaries and possible legal challenges if medical marijuana dispensaries are treated differently than other businesses in <br />the City. <br />In response to the Commission's question, Ms. Hanna said she is hoping to bring this back to the Commission in <br />January 2016. <br />
